in forceThe health insurers · § The equalization contribution and the contribution for maintaining the insurance of insured persons for whom an administrative law premium is due
For the purposes of this Article, the following definitions shall apply:
catastrophe: a natural disaster, a pandemic, a nuclear explosion or any other extraordinary event to be designated by ministerial regulation;
catastrophe year: the calendar year in which a catastrophe occurs;
average equalization contribution: the awarded equalization contribution per insured person, which is calculated by dividing the sum of the equalization contributions awarded to all health insurers pursuant to Article 32 in relation to the catastrophe year by the total number of insured persons in that year as expected at the time of the awarding of those contributions.
If the costs for care or other services insured under health insurance policies are expected by the Zorginstituut, as a result of a catastrophe, to be higher for a health insurer in the catastrophe year and the subsequent calendar year combined than 4% of the product of the average risk equalisation contribution and the number of insured persons with that insurer expected at the time of the allocation of the risk equalisation contribution for the catastrophe year, the Zorginstituut shall grant the insurer that submits a petition to that effect an additional contribution in addition to the risk equalisation contribution allocated to it for the catastrophe year.
A health insurer to whom an additional contribution as referred to in the second paragraph has been granted shall maintain separate records of the costs of insured care and other services incurred as a result of the catastrophe in the year of the catastrophe and the subsequent calendar year.
Ministerial regulations shall establish rules regarding the calculation of the contributions and may establish rules regarding the administration, as referred to in the third paragraph, and the manner in which the granted contributions are paid by the Healthcare Institute (Zorginstituut).
Article 32, paragraphs 5 and 7, shall apply mutatis mutandis, with the exception of the obligation included in that fifth paragraph to establish the policy rules annually before 15 October.
In dit artikel wordt verstaan onder:
catastrofe: een natuurramp, een pandemie, een kernexplosie of een bij ministeriële regeling aan te wijzen andere buitengewone gebeurtenis;
catastrofejaar: het kalenderjaar waarin een catastrofe optreedt;
gemiddelde vereveningsbijdrage: de toegekende vereveningsbijdrage per verzekerde, die wordt berekend door de som van de op grond van artikel 32 met betrekking tot het catastrofejaar aan alle zorgverzekeraars toegekende vereveningsbijdragen te delen door het op het moment van toekenning van die bijdragen verwachte totaalaantal verzekerden in dat jaar.
Indien de kosten voor de op grond van de zorgverzekeringen verzekerde zorg of andere diensten ten gevolge van een catastrofe naar verwachting van het Zorginstituut in het catastrofejaar en het daaropvolgende kalenderjaar tezamen, voor een zorgverzekeraar hoger zullen zijn dan 4% van het product van de gemiddelde vereveningsbijdrage en het op het moment van de toekenning van de vereveningsbijdrage over het catastrofejaar verwachte aantal verzekerden bij die verzekeraar, kent het Zorginstituut de verzekeraar die daar om verzoekt naast de hem voor het catastrofejaar toegekende vereveningsbijdrage een extra bijdrage toe.
Een zorgverzekeraar aan wie een extra bijdrage als bedoeld in het tweede lid is toegekend, houdt een afzonderlijke administratie bij van de in het catastrofejaar en het daaropvolgende kalenderjaar ten gevolge van de catastrofe optredende kosten van verzekerde zorg en andere diensten.
Bij ministeriële regeling worden regels gesteld omtrent de berekening van de bijdragen en kunnen regels worden gesteld over de administratie, bedoeld in het derde lid, en de wijze waarop de toegekende bijdragen door het Zorginstituut worden betaald.
Artikel 32, vijfde en zevende lid, zijn, met uitzondering van de in dat vijfde lid opgenomen verplichting de beleidsregels jaarlijks voor 15 oktober vast te stellen, van overeenkomstige toepassing.
