in forceThe obligation to conclude a health insurance contract · § The obligation to insure
Any person who is insured by operation of law pursuant to the Long-Term Care Act (Wet langdurige zorg) and the regulations based thereon, is obliged to insure themselves or to be insured under a health insurance policy against the risk referred to in Article 10.
By way of derogation from the first paragraph, the following are not subject to compulsory insurance:
the military official in active service as referred to in Article 1, paragraph 1, opening words and part (a) in conjunction with part (b), of the Defence Officials Act (Wet ambtenaren defensie), as well as the military personnel to whom extraordinary leave with retention of military income has been granted;
the natural person who, pursuant to Article 64, paragraph 1, of the Financing of Social Insurance Act (Wet financiering sociale verzekeringen), has been exempted from the obligations imposed pursuant to the Long-term Care Act (Wet langdurige zorg).
The person exercising parental responsibility over a minor under the age of eighteen, a curator, an administrator (bewindvoerder), or a mentor as referred to in Titles 16, 19, or 20 of Book 1 of the Civil Code, shall ensure that the minor subject to the insurance obligation, or the person subject to the insurance obligation who is under curatorship, administration, or mentorship, is insured under a healthcare insurance.
Degene die ingevolge de Wet langdurige zorg en de daarop gebaseerde regelgeving van rechtswege verzekerd is, is verplicht zich krachtens een zorgverzekering te verzekeren of te laten verzekeren tegen het in artikel 10 bedoelde risico.
In afwijking van het eerste lid is niet verzekeringsplichtig:
de militaire ambtenaar in werkelijke dienst als bedoeld in artikel 1, eerste lid, onderdeel a juncto onderdeel b, van de Wet ambtenaren defensie, alsmede de militair aan wie buitengewoon verlof met behoud van militaire inkomsten is verleend;
de natuurlijke persoon die op grond van artikel 64, eerste lid, van de Wet financiering sociale verzekeringen is ontheven van de verplichtingen, opgelegd op grond van de Wet langdurige zorg.
Degene die het gezag over een minderjarige, jonger dan achttien jaar, uitoefent, een curator, een bewindvoerder of een mentor als bedoeld in de titels 16, 19 of 20 van Boek 1 van het Burgerlijk Wetboek, zorgt ervoor dat de minderjarige verzekeringsplichtige, dan wel de onder curatele, bewind of mentorschap gestelde verzekeringsplichtige krachtens een zorgverzekering verzekerd is.
