The Employee Insurance Agency (Uitvoeringsinstituut werknemersverzekeringen) shall, in respect of insured persons from whom a notification of illness has been received or for whom a report of illness has been received pursuant to Article 38, paragraph 2, or Article 38a, perform a verification of the existence of incapacity to perform their work due to illness, and it shall assess, in the event of established incapacity, whether the employer is adequately performing its duties regarding sickness absence supervision.
The Employee Insurance Agency (Uitvoeringsinstituut werknemersverzekeringen) shall, for the purpose of monitoring the existence of incapacity for work, establish monitoring regulations, which may differ for one or more specific groups of employees.
The Employee Insurance Agency (Uitvoeringsinstituut werknemersverzekeringen) is authorised to communicate its inspection findings to the employer with whom the employee subject to inspection is in an employment relationship. It shall, upon the employer's request, inform the employer whether a specific employee in an employment relationship with him is, according to the data available to the Employee Insurance Agency, fit to perform his work.
The Employee Insurance Agency (Uitvoeringsinstituut werknemersverzekeringen) shall determine the percentage of the income of the person in a comparable position (maatmaninkomen) that the insured person is able to earn, as referred to in Article 19aa, and shall verify whether the insured person, as referred to in Article 19aa, paragraph 1, is entitled to sickness benefit.
Het Uitvoeringsinstituut werknemersverzekeringen verricht bij verzekerden van wie op grond van artikel 38, tweede lid of 38a een aangifte van ziekte of van wie een ziekmelding is ontvangen, controle op het bestaan van ongeschiktheid tot het verrichten van hun arbeid wegens ziekte en hij beoordeelt bij gebleken ongeschiktheid of de werkgever zijn taak met betrekking tot verzuimbegeleiding op adequate wijze uitoefent.
Het Uitvoeringsinstituut werknemersverzekeringen stelt ter uitvoering van de controle op het bestaan van ongeschiktheid tot het verrichten van arbeid controlevoorschriften vast, die voor een of meer bepaalde groepen van werknemers kunnen verschillen.
Het Uitvoeringsinstituut werknemersverzekeringen is bevoegd zijn controlebevindingen mee te delen aan de werkgever tot wie de aan controle onderworpen werknemer in dienstbetrekking staat. Het deelt de werkgever op diens verzoek mee of een bepaalde, tot hem in dienstbetrekking staande werknemer volgens de gegevens die het Uitvoeringsinstituut werknemersverzekeringen ter beschikking staan geschikt is tot het verrichten van zijn arbeid.
Het Uitvoeringsinstituut werknemersverzekeringen stelt het percentage van het maatmaninkomen dat de verzekerde kan verdienen, bedoeld in artikel 19aa, vast, en controleert of de verzekerde, bedoeld in artikel 19aa, eerste lid, recht heeft op ziekengeld.
