Insofar as a treaty expressly provides for this, the enforcement or continued enforcement of a custodial sanction imposed in a foreign state may, upon the instruction of Our Minister, take place in the Netherlands outside the application of Sections A, B and C of this Chapter, but with due observance of the provisions of this Paragraph.
The designation referred to in the previous paragraph may, insofar as the applicable treaty provides that the consent of the convicted person or their legal representative to their transfer to the Netherlands for the purpose of enforcement or continued enforcement is required, only be given if such consent is evidenced by a written document.
Voor zover een verdrag daarin uitdrukkelijk voorziet, kan op aanwijzing van Onze Minister de tenuitvoerlegging of verdere tenuitvoerlegging van een in een vreemde staat opgelegde vrijheidsbenemende sanctie in Nederland plaatsvinden buiten toepassing van de afdelingen A, B en C van dit hoofdstuk, maar met inachtneming van het bepaalde in deze paragraaf.
De in het vorige lid bedoelde aanwijzing kan, voor zover het toepasselijke verdrag bepaalt dat de instemming van de veroordeelde of diens wettelijke vertegenwoordiger met zijn overbrenging naar Nederland met het oog op de tenuitvoerlegging of voortgezette tenuitvoerlegging is vereist, slechts worden gegeven indien die instemming uit een schriftelijk stuk blijkt.
