If the sanction imposed in the foreign state exclusively concerns the payment of a fine, possibly under threat of a substitute sanction involving deprivation of liberty, it shall be enforced pursuant to a decision of the public prosecutor.
Before taking a decision pursuant to the previous paragraph, the public prosecutor shall give the convicted person the opportunity to be heard.
The public prosecutor shall express the amount of the fine in Dutch currency in accordance with the provisions of the applicable treaty. If the treaty does not contain any regulations in this regard, the public prosecutor shall determine the amount of the fine according to the exchange rate that was applicable at the time of the conviction in the foreign state. The exchange rate shall be the mid-market rate of the quotation established at the Amsterdam stock exchange.
For currencies for which the exchange rate is not quoted daily on the Amsterdam stock exchange, the exchange rate shall apply that is derived from the value in special drawing rights of the currency concerned on the last working day of the month in which the sanction to be enforced was imposed in the foreign state.
Indien de in de vreemde staat opgelegde sanctie uitsluitend strekt tot de betaling van een geldboete, eventueel onder bedreiging met een vervangende tot vrijheidsbeneming strekkende sanctie, wordt deze ten uitvoer gelegd krachtens een beslissing van de officier van justitie.
Alvorens een beslissing te nemen ingevolge het vorige lid stelt de officier van justitie de veroordeelde in de gelegenheid te worden gehoord.
De officier van justitie drukt overeenkomstig het bepaalde in het toepasselijke verdrag het bedrag van de geldboete uit in Nederlandse valuta. Indien het verdrag daaromtrent geen voorschriften bevat bepaalt de officier van justitie de hoogte van het bedrag volgens de wisselkoers die gold op het tijdstip van veroordeling in de vreemde staat. Als wisselkoers geldt de middenkoers van de op de koopmansbeurs te Amsterdam tot stand gekomen notering.
Voor valuta waarvan de wisselkoers niet dagelijks op de koopmansbeurs te Amsterdam wordt genoteerd geldt de wisselkoers die wordt verkregen uit de waarde in speciale trekkingsrechten van de desbetreffende valuta op de laatste werkdag van de maand waarin de ten uitvoer te leggen sanctie in de vreemde staat werd opgelegd.
