Custody may be ordered for a term of no more than fourteen days. Upon the motion of the public prosecutor, it may be extended each time by a term of no more than thirty days, until the court decides on the remand in custody pursuant to Article 29, paragraph 2.
The convicted person whose detention has been ordered shall be released, save for the possibility of deprivation of liberty on other grounds:
as soon as this is ordered by the court, the examining magistrate or the public prosecutor, either of their own motion or upon the petition of the convicted person or their counsel;
as soon as the custody has lasted for fourteen days and the public prosecutor has not received the documents referred to in Articles 15 or 17;
if the duration of the police custody (inverzekeringstelling) and the remand in custody (bewaring) would exceed that of the portion of the sanction imposed in the foreign state that is subject to enforcement.
De bewaring kan worden gelast voor een termijn van ten hoogste veertien dagen. Zij kan op vordering van de officier van justitie telkens met een termijn van ten hoogste dertig dagen worden verlengd, totdat de rechtbank ingevolge artikel 29, tweede lid, over de gevangenhouding beslist.
De veroordeelde wiens bewaring is gelast wordt, behoudens de mogelijkheid van vrijheidsbeneming uit anderen hoofde, in vrijheid gesteld:
zodra zulks door de rechtbank, de rechter-commissaris of de officier van justitie ambtshalve of op verzoek van de veroordeelde of diens raadsman wordt gelast;
zodra de bewaring veertien dagen heeft geduurd en de officier van justitie de in de artikelen 15 of 17 bedoelde stukken niet heeft ontvangen;
indien de duur van de inverzekeringstelling en de bewaring die van het voor tenuitvoerlegging vatbare gedeelte van de in de vreemde staat opgelegde sanctie zou overtreffen.
