Our Minister may issue an instruction as referred to in Article 61d to an admitted institution, aimed at the continuation of the necessary activities referred to in Article 56a, paragraph 2, point (a), or a part thereof, of the admitted institution referred to in that paragraph, if:
the relevant approved institution is effectively active in the same area as referred to in Article 41b, paragraph 2, as that other approved institution;
it follows from the advice, as referred to in Article 56a, paragraph 2, that such continuation can reasonably be required of the relevant admitted institution;
the relevant approved institution, having regard to the financial standards made known by the authority, possesses demonstrably sufficient additional financial and operational capacity to implement that instruction; and
the guarantee facility has provided its views on the intended designation.
Further regulations regarding the application of the designation referred to in the first paragraph shall be provided by or pursuant to an Order in Council.
Onze Minister kan aan een toegelaten instelling een aanwijzing als bedoeld in artikel 61d geven, strekkende tot het voortzetten van de in artikel 56a, tweede lid, onderdeel a, bedoelde noodzakelijke werkzaamheden, dan wel een deel daarvan, van de in dat lid bedoelde toegelaten instelling, indien:
de betreffende toegelaten instelling feitelijk werkzaam is in hetzelfde gebied als bedoeld in artikel 41b, tweede lid, als die andere toegelaten instelling;
uit het advies, bedoeld in artikel 56a, tweede lid, volgt dat dit voortzetten in redelijkheid van de betreffende toegelaten instelling kan worden verlangd;
de betreffende toegelaten instelling, gelet op de door de autoriteit kenbaar gemaakte financiële normen, beschikt over aantoonbaar voldoende additionele financiële en operationele ruimte om die aanwijzing uit te voeren; en
de borgingsvoorziening een zienswijze heeft gegeven over de voorgenomen aanwijzing.
Bij of krachtens algemene maatregel van bestuur worden nadere voorschriften gegeven over de toepassing van de aanwijzing, bedoeld in het eerste lid.
