The chair of the Chamber for the Notarial Profession may, upon the petition of an interested party whose financial capacity does not exceed the amounts referred to in Article 34 of the Legal Aid Act, instruct a civil-law notary established in the relevant district to perform the official duties mentioned in the second paragraph for an amount the maximum of which is the amount of the highest possible personal contribution pursuant to the order in council referred to in Article 35, second paragraph, of the Legal Aid Act.

The first paragraph applies to activities relating to:

a.

notarial deeds containing a last will and testament, marriage settlements, partnership agreements, cohabitation agreement, and the appointment of a guardian;

b.

notarial deeds of partition of joint property if the costs of the civil-law notary cannot be satisfied from the joint property;

c.

certificates of inheritance if the balance of the estate is less than the amount referred to in Article 34, paragraph 2, of the Legal Aid Act (Wet op de rechtsbijstand) for the assets of a single person.

The petitioner shall submit to the presiding judge a statement from the Legal Aid Board (Raad voor rechtsbijstand), as referred to in Article 1 of the Legal Aid Act, showing the income of the petitioner.

For those to whom the first three paragraphs do not apply, the fee for the official duties referred to therein shall be subject to a maximum of four times the amount referred to in the first paragraph. This latter maximum shall not apply if the net assets of a party to the deed or of the parties together exceed € 226,890. This amount may be amended by ministerial regulation insofar as the consumer price index gives cause to do so.

Rules shall be laid down by Order in Council regarding the manner in which the amount of the equity capital referred to in the fourth paragraph is determined.

De voorzitter van de kamer voor het notariaat kan op verzoek van een belanghebbende wiens financiële draagkracht de in artikel 34 van de Wet op de rechtsbijstand genoemde bedragen niet overschrijdt, een in het desbetreffende ressort gevestigde notaris opdragen de in het tweede lid genoemde ambtelijke werkzaamheden te verrichten tegen een bedrag waarvan de maximumhoogte het bedrag is van de ingevolge de algemene maatregel van bestuur, bedoeld in artikel 35, tweede lid, van de Wet op de rechtsbijstand, hoogst mogelijke eigen bijdrage.

Het eerste lid is van toepassing op werkzaamheden met betrekking tot:

a.

notariële akten houdende testament, huwelijkse voorwaarden, partnerschapsvoorwaarden, samenlevingsovereenkomst en voogdijbenoeming;

b.

notariële akten van scheiding van onverdeeldheden indien uit de onverdeeldheid de kosten van de notaris niet kunnen worden voldaan;

c.

verklaringen van erfrecht indien het saldo van de boedel minder bedraagt dan het in artikel 34, tweede lid, van de Wet op de rechtsbijstand genoemde bedrag voor het vermogen van een alleenstaande.

De verzoeker legt aan de voorzitter een verklaring over van de raad voor rechtsbijstand, bedoeld in artikel 1, van de Wet op de rechtsbijstand, waaruit het inkomen van de verzoeker blijkt.

Voor degenen op wie de eerste drie leden niet van toepassing zijn geldt voor de daarin bedoelde ambtelijke werkzaamheden een tarief waarvan het maximum bedraagt vier maal het in het eerste lid bedoelde bedrag. Dit laatste maximum geldt niet indien het eigen vermogen van een partij bij de akte of van partijen tezamen meer bedraagt dan € 226 890. Dit bedrag kan bij ministeriële regeling worden gewijzigd voorzover de consumentenprijsindex daartoe aanleiding geeft.

Bij algemene maatregel van bestuur worden regels gesteld met betrekking tot de wijze waarop de hoogte van het in het vierde lid bedoelde eigen vermogen wordt bepaald.
