Complaints against civil-law notaries, junior civil-law notaries, and candidate civil-law notaries may be submitted in writing and with reasons stated by any person with a reasonable interest to the Chamber for the Notarial Profession under whose jurisdiction the civil-law notary, junior civil-law notary, or candidate civil-law notary falls. If the complainant so requests, the secretary of the Chamber shall assist them in putting the complaint into writing. A copy of the complaint shall be sent to the KNB and the Bureau.

Before a complaint as referred to in the first paragraph is taken into consideration, the secretary shall levy a court fee of € 50. The court fee shall accrue to the chambers for the civil-law notary profession (kamers voor het notariaat).

The secretary shall draw the complainant's attention to the court fee due and inform him that the amount due must be credited to the bank account number made known for that purpose within four weeks of the date of dispatch of his notification.

If a complaint is not brought to the attention of the chamber but is settled amicably as referred to in the twelfth paragraph, it may be determined by the parties as part of the amicable settlement that the court registry fee paid by the complainant shall be reimbursed by the civil-law notary, junior civil-law notary, or candidate civil-law notary involved.

If the complaint is declared well-founded in whole or in part, the court registry fee paid by the complainant shall be reimbursed by the civil-law notary, junior civil-law notary or candidate civil-law notary concerned.

By way of derogation from the second paragraph, no court fee shall be levied if the complaint originates from:

a.

Our Minister;

b.

the Office; or

c.

The Royal Dutch Association of Civil-law Notaries (KNB).

Our Minister may amend the amount referred to in the second paragraph insofar as the consumer price index gives cause to do so.

If a complaint has been filed regarding members or deputy members of the Chamber for the Notarial Profession who are a civil-law notary, junior civil-law notary, or candidate civil-law notary, the chair of the chamber shall request the president of the Amsterdam Court of Appeal to designate another chamber to be charged with the handling thereof. The president shall communicate the decision to the designated chamber, to the civil-law notary, junior civil-law notary, or candidate civil-law notary concerned, to the chair of the chamber that submitted the request for designation, and to the complainant.

A complaint is inadmissible insofar as it relates to conduct for which a fine has been imposed as referred to in Article 111b. Furthermore, a complaint is inadmissible if the court fee has not been credited to the bank account number made known for that purpose within the period referred to in the third paragraph.

If, in the judgment of the chairperson, the complaint is suitable for such action and it appears from the complaint that it has not yet been submitted to the disputes committee referred to in Article 55, paragraph 2, the chairperson may decide to suspend the handling of the complaint and to provide the complainant with the opportunity to submit the dispute to the disputes committee. The decision to suspend shall suspend the time limit referred to in the fifteenth paragraph. No legal remedy is permitted against this decision.

The chairperson may, after a summary investigation and, if necessary, after having heard the complainant and the civil-law notary, acting civil-law notary, or junior civil-law notary concerned, immediately dismiss the complaint by a reasoned decision if he is of the opinion that it is manifestly inadmissible, manifestly unfounded, or of insufficient weight.

If the chairperson is of the opinion that a complaint is susceptible to an amicable settlement, he shall summon the complainant and the civil-law notary, junior civil-law notary, or candidate civil-law notary concerned in order to attempt such a settlement. If an amicable settlement proves possible, it shall be drawn up in writing and signed by the complainant, the civil-law notary, junior civil-law notary, or candidate civil-law notary against whom the complaint has been filed, and the chairperson.

The chairperson shall bring complaints that have not been submitted to the disputes committee, have not been settled amicably, or have been rejected, to the attention of the chamber.

The secretary shall without delay send a copy of the chairperson's decision to the complainant and the civil-law notary, junior civil-law notary or candidate civil-law notary concerned; in the event of the dismissal of a complaint, it shall be sent to the complainant by registered letter. If the chairperson applies the fourth paragraph, he shall state the complainant's right to request the chamber to take the complaint into consideration after the proceedings before the disputes committee have been concluded.

The complainant may lodge a written objection with the Chamber for the Notarial Profession (kamer voor het notariaat) against the decision of the chairperson to dismiss a complaint, within fourteen days after the date of dispatch of the copy of the decision. The complainant must state with reasons which considerations of the chairperson they cannot agree with. In doing so, the complainant may request to be heard regarding their objection.

If an objection has been lodged against the decision of the presiding judge in accordance with the fifteenth paragraph, the latter shall appoint a substitute to replace him in the handling of the objection.

As a consequence of the objection, the decision shall lapse, unless the Chamber for the Notarial Profession declares the objection inadmissible or unfounded.

18.

If the Chamber for the Notarial Profession (kamer voor het notariaat) is of the opinion that the complaint is manifestly inadmissible, manifestly unfounded, or of insufficient weight, it may declare the objection unfounded without further investigation, provided that it has first given the complainant who requested so the opportunity to be heard.

19.

The decision to declare the objection inadmissible or unfounded shall be reasoned. No legal remedy shall be available against this decision. The eighth paragraph shall apply mutatis mutandis.

If the court is of the opinion that the objection is well-founded, the case shall be taken into further consideration.

21.

A complaint may only be filed within three years from the day on which the person entitled to file a complaint has become aware of the act or omission of a civil-law notary, junior civil-law notary, or candidate civil-law notary that may give rise to disciplinary measures. If the complaint is filed after the expiry of three years from the day on which the complainant became aware or could reasonably have become aware of the act or omission of the civil-law notary to which the complaint relates, the complaint shall be declared inadmissible by the chairperson. The decision to declare the complaint inadmissible shall be omitted if the consequences of the act or omission only became reasonably known thereafter. In that case, the period for filing a complaint shall expire one year after the date on which the consequences can reasonably be considered to have become known.

22.

Withdrawal of the complaint after it has been received, or the cessation of activities by the person against whom the complaint has been lodged, shall have no influence on the further proceedings if, in the opinion of the Chamber for the Notarial Profession (kamer voor het notariaat), the public interest requires the continuation of the proceedings, or if the person against whom the complaint has been lodged has declared in writing that they desire the continuation of the proceedings regarding the complaint.

Klachten tegen notarissen, toegevoegd notarissen en kandidaat-notarissen kunnen, schriftelijk en met redenen omkleed, door een ieder met enig redelijk belang worden ingediend bij de kamer voor het notariaat waaronder de notaris, toegevoegd notaris of kandidaat-notaris ressorteert. Indien de klager daarom verzoekt, is de secretaris van de kamer hem behulpzaam bij het op schrift stellen van de klacht. Van de klacht wordt een afschrift gezonden aan de KNB en het Bureau.

Voordat een klacht als bedoeld in het eerste lid in behandeling wordt genomen, heft de secretaris een griffierecht van € 50. Het griffierecht komt ten bate van de kamers voor het notariaat.

De secretaris wijst de klager op de verschuldigdheid van het griffierecht en deelt hem mee dat het verschuldigde bedrag binnen vier weken na de dag van verzending van zijn mededeling dient te zijn bijgeschreven op het daartoe bekend gemaakte bankrekeningnummer.

Indien een klacht niet ter kennis van de kamer wordt gebracht maar in der minne is geschikt als bedoeld in het twaalfde lid, kan als onderdeel van de minnelijke schikking door partijen worden bepaald dat het door de klager betaalde griffierecht wordt vergoed door de betrokken notaris, toegevoegd notaris dan wel kandidaat-notaris.

Indien de klacht geheel of gedeeltelijk gegrond wordt verklaard, wordt het door de klager betaalde griffierecht vergoed door de betrokken notaris, toegevoegd notaris dan wel kandidaat-notaris.

In afwijking van het tweede lid, wordt geen griffierecht geheven indien de klacht afkomstig is van:

a.

Onze Minister;

b.

het Bureau; of

c.

de KNB.

Onze Minister kan het in het tweede lid bedoelde bedrag wijzigen voor zover de consumentenprijsindex daartoe aanleiding geeft.

Indien een klacht is ingediend met betrekking tot de leden of plaatsvervangende leden van de kamer voor het notariaat die notaris, toegevoegd notaris of kandidaat-notaris zijn, verzoekt de voorzitter van de kamer de president van het gerechtshof Amsterdam om een andere kamer aan te wijzen teneinde zich met de behandeling daarvan te belasten. De president deelt de beslissing mee aan de aangewezen kamer, aan de desbetreffende notaris, toegevoegd notaris of kandidaat-notaris, aan de voorzitter van de kamer die het verzoek tot aanwijzing heeft gedaan en aan de klager.

Een klacht is niet ontvankelijk voorzover deze betrekking heeft op een gedraging waarvoor een boete is opgelegd als bedoeld in artikel 111b. Voorts is een klacht niet ontvankelijk als het griffierecht niet binnen de in het derde lid bedoelde termijn is bijgeschreven op het daartoe bekend gemaakte bankrekeningnummer.

Indien de klacht zich naar het oordeel van de voorzitter daartoe leent en uit de klacht blijkt dat de klacht nog niet is voorgelegd aan de geschillencommissie, bedoeld in artikel 55, tweede lid, kan de voorzitter besluiten de behandeling van de klacht te schorsen, en de klager in de gelegenheid te stellen het geschil voor te leggen aan de geschillencommissie. De beslissing tot schorsing schorst de in het vijftiende lid bedoelde termijn. Tegen de beslissing is geen voorziening toegelaten.

De voorzitter kan na een summier onderzoek, zo nodig na de klager en de betrokken notaris, toegevoegd notaris of kandidaat-notaris te hebben gehoord, de klacht terstond bij met redenen omklede beslissing afwijzen indien hij van oordeel is dat deze kennelijk niet ontvankelijk, dan wel kennelijk ongegrond is, of van onvoldoende gewicht.

Indien de voorzitter van oordeel is dat een klacht vatbaar is voor minnelijke schikking, roept hij de klager en de betrokken notaris, toegevoegd notaris of kandidaat-notaris op teneinde een zodanige schikking te beproeven. Indien een minnelijke schikking mogelijk blijkt, wordt deze op schrift gesteld en door de klager, de notaris, toegevoegd notaris of de kandidaat-notaris tegen wie de klacht is ingediend en de voorzitter ondertekend.

De voorzitter brengt klachten die niet zijn neergelegd bij de geschillencommissie, niet in der minne zijn geschikt of zijn afgewezen, ter kennis van de kamer.

Van de beslissing van de voorzitter zendt de secretaris onverwijld een afschrift aan de klager en de betrokken notaris, toegevoegd notaris of kandidaat-notaris, in geval van afwijzing van een klacht aan de klager bij aangetekende brief. Indien de voorzitter toepassing geeft aan het vierde lid, vermeldt hij de bevoegdheid van de klager om na ommekomst van de behandeling door de geschillencommissie de kamer te verzoeken de klacht alsnog in behandeling te nemen.

Tegen de beslissing van de voorzitter tot afwijzing van een klacht, kan de klager binnen veertien dagen na de dag van verzending van het afschrift van de beslissing schriftelijk verzet doen bij de kamer voor het notariaat. Hij dient gemotiveerd aan te geven met welke overwegingen van de voorzitter hij zich niet kan verenigen. Hij kan daarbij vragen over zijn verzet te worden gehoord.

16.

Indien overeenkomstig het vijftiende lid verzet is gedaan tegen de beslissing van de voorzitter, wijst deze een plaatsvervanger aan om hem bij de behandeling van het verzet te vervangen.

Ten gevolge van het verzet vervalt de beslissing, tenzij de kamer voor het notariaat het verzet niet-ontvankelijk of ongegrond verklaart.

18.

Is de kamer voor het notariaat van oordeel dat de klacht kennelijk niet-ontvankelijk, kennelijk ongegrond of van onvoldoende gewicht is, dan kan zij zonder nader onderzoek het verzet ongegrond verklaren, echter niet dan na de klager die daarom vroeg in de gelegenheid te hebben gesteld te worden gehoord.

19.

De beslissing tot niet-ontvankelijkverklaring of ongegrondverklaring van het verzet is met redenen omkleed. Daartegen staat geen rechtsmiddel open. Het achtste lid is van overeenkomstige toepassing.

20.

Is de kamer van oordeel dat het verzet gegrond is, dan wordt de zaak in verdere behandeling genomen.

21.

Een klacht kan slechts worden ingediend gedurende drie jaren na de dag waarop de tot klacht gerechtigde van het handelen of nalaten van een notaris, toegevoegd notaris of kandidaat-notaris dat tot tuchtrechtelijke maatregelen aanleiding kan geven kennis heeft genomen. Indien de klacht wordt ingediend na verloop van drie jaren na de dag waarop de klager heeft kennisgenomen of redelijkerwijs kennis heeft kunnen nemen van het handelen of nalaten van de notaris waarop de klacht betrekking heeft, wordt de klacht door de voorzitter niet-ontvankelijk verklaard. De beslissing tot niet-ontvankelijkverklaring blijft achterwege indien de gevolgen van het handelen of nalaten redelijkerwijs pas nadien bekend zijn geworden. In dat geval verloopt de termijn voor het indienen van een klacht een jaar na de datum waarop de gevolgen redelijkerwijs als bekend geworden zijn aan te merken.

22.

Intrekken van de klacht, nadat deze is ingekomen, of staking van de werkzaamheden door de persoon over wie geklaagd is, heeft op de verdere behandeling geen invloed, wanneer naar het oordeel van de kamer voor het notariaat het algemeen belang de voortzetting van de behandeling vordert of wanneer degene over wie geklaagd is, schriftelijk heeft verklaard voortzetting van de behandeling van de klacht te verlangen.
