A junior civil-law notary (kandidaat-notaris) is eligible for appointment as an associate to a civil-law notary if they satisfy the requirements of Article 6, with the exception of the second paragraph, point (b), under 4°, and if the requirements resulting from Article 30b, second paragraph, are met.
The petition for approval of the addition shall be submitted jointly by the civil-law notary and the candidate civil-law notary. Article 8 shall apply mutatis mutandis, on the understanding that the supporting documents to be submitted with the petition shall also relate to the fulfilment of the conditions arising from Article 30b, paragraph 2, and that the advice of the Committee for Access to the Notarial Profession (Commissie toegang notariaat) shall also address the question of whether these conditions are met. Further conditions may be attached to the approval.
The junior civil-law notary (toegevoegd notaris) who is attached to a civil-law notary shall, if this has not previously occurred, take the oath before the court in the district where the chamber for the civil-law notary profession (kamer voor het notariaat) is established under whose jurisdiction the civil-law notary to whom he is attached falls, in connection with the acceptance of his attachment. Article 3, paragraphs two up to and including five, and Article 4 shall apply mutatis mutandis.
Een kandidaat-notaris komt in aanmerking voor toevoeging aan een notaris indien hij voldoet aan de voorwaarden van artikel 6, met uitzondering van het tweede lid, onderdeel b, onder 4°, en indien wordt voldaan aan de voorwaarden die volgen uit artikel 30b, tweede lid.
Het verzoek om goedkeuring van de toevoeging wordt ingediend door de notaris en de kandidaat-notaris gezamenlijk. Artikel 8 is van overeenkomstige toepassing, met dien verstande dat de bij het verzoek over te leggen bewijsstukken tevens betrekking hebben op de vervulling van de voorwaarden die volgen uit artikel 30b, tweede lid, en dat het advies van de Commissie toegang notariaat tevens ziet op de vraag of aan deze voorwaarden wordt voldaan. Aan de goedkeuring kunnen nadere voorwaarden worden verbonden.
De toegevoegd notaris die aan een notaris wordt toegevoegd, legt, indien dit nog niet eerder heeft plaatsgevonden, in verband met de aanvaarding van zijn toevoeging de eed af voor de rechtbank in het arrondissement waarin de kamer voor het notariaat is gevestigd waaronder de notaris aan wie hij wordt toegevoegd ressorteert. Artikel 3, tweede tot en met vijfde lid, en artikel 4 zijn van overeenkomstige toepassing.
