Article 2:17

The convicted person shall not be prosecuted, punished or restricted in his personal liberty in any other way in the Netherlands in respect of acts committed prior to the time of his transfer for which he has not been transferred, unless:
the convicted person has not left the Netherlands within forty-five days after his release, although he had the opportunity to do so, or the convicted person has left the Netherlands but has returned;
the facts are not punishable by a custodial sentence;
the criminal prosecution does not lead to the application of any measure restricting liberty;
it concerns the enforcement of a sanction other than a custodial sentence;
the convicted person has consented to the transfer;
the convicted person has expressly waived the protection under this article after his transfer; or
provided that prior consent for this purpose has been obtained from the competent authority of the issuing Member State.
De veroordeelde wordt in Nederland niet vervolgd, gestraft of op enige andere wijze in zijn persoonlijke vrijheid beperkt, ter zake van feiten die vóór het tijdstip van zijn overbrenging zijn begaan en waarvoor hij niet is overgebracht, tenzij:
de veroordeelde niet binnen vijfenveertig dagen na zijn invrijheidstelling Nederland heeft verlaten, hoewel hij daartoe de mogelijkheid had, of de veroordeelde Nederland heeft verlaten, maar er is teruggekeerd;
de feiten niet zijn bedreigd met een vrijheidsbenemende sanctie;
de strafvervolging niet leidt tot de toepassing van enige maatregel die de vrijheid beperkt;
het gaat om de tenuitvoerlegging van een andere dan een vrijheidsbenemende sanctie;
de veroordeelde met de overbrenging heeft ingestemd;
de veroordeelde na zijn overbrenging uitdrukkelijk afstand heeft gedaan van de bescherming op grond van dit artikel; of
daartoe voorafgaand toestemming van de bevoegde autoriteit van de uitvaardigende lidstaat is verkregen.
