If an investigation as referred to in Article 126gg has as its purpose the preparation of the investigation of terrorist offences, the public prosecutor may, after prior written authorisation granted upon his motion by the examining magistrate, in the interest of the investigation, demand in writing from a person who can reasonably be suspected of having access to an automated data file that this file, or parts thereof, be provided, in order to have the data contained therein processed. The persons referred to in Articles 218 and 218a are not obliged to comply with the demand, insofar as the disclosure would be in conflict with their duty of confidentiality.

The processing may consist of comparing or combining the data from the provided file with data from police registers and data from other files. Restrictions imposed by or pursuant to the Police Data Act (Wet politiegegevens) shall not apply. The public prosecutor shall determine the manner in which the processing is carried out.

The processing shall be carried out in such a manner that the protection of the personal privacy of individuals is safeguarded as much as possible.

The public prosecutor shall cause an official report to be drawn up of the processing, in which the following shall be stated:

a.

an indication of the data on which the processing has been performed;

b.

a description of the manner in which the processing has been carried out;

c.

the facts and circumstances from which it appears that the conditions referred to in the first paragraph have been fulfilled.

The public prosecutor shall ensure that, as soon as the processing has been completed:

a.

exclusively the data that are the result of the processing and are relevant to the investigation shall be further processed for the investigation;

b.

Data resulting from the processing which are not relevant to the investigation, as well as data obtained pursuant to the first paragraph which do not form part of the result of the processing, shall be destroyed.

Data as referred to in the fifth paragraph, under (a), may be processed for the investigation of terrorist offences.

The public prosecutor may, by way of derogation from the fifth paragraph, under (b), determine that the data referred to in that point shall not be destroyed insofar as and for as long as the data are necessary to verify the processing ex post. If the data are not destroyed, they shall be processed exclusively for the purpose of verifying the processing ex post.

Indien een onderzoek als bedoeld in artikel 126gg de voorbereiding van de opsporing van terroristische misdrijven tot doel heeft, kan de officier van justitie na voorafgaande schriftelijke machtiging, op zijn vordering te verlenen door de rechter-commissaris, in het belang van het onderzoek van degene van wie redelijkerwijs kan worden vermoed dat hij toegang heeft tot een geautomatiseerd gegevensbestand schriftelijk vorderen dit bestand, of delen daarvan, te verstrekken, teneinde de hierin opgenomen gegevens te doen bewerken. De personen, bedoeld in de artikelen 218 en 218a, zijn niet verplicht aan de vordering te voldoen, voor zover de uitlevering met hun plicht tot geheimhouding in strijd zou zijn.

De bewerking kan bestaan uit het onderling vergelijken dan wel het in combinatie met elkaar verwerken van de gegevens uit het verstrekte bestand, gegevens uit de politieregisters en gegevens uit andere bestanden. Beperkingen gesteld bij of krachtens de Wet politiegegevens blijven buiten toepassing. De officier van justitie stelt de wijze waarop de bewerking wordt uitgevoerd vast.

De bewerking wordt op een zodanige wijze uitgevoerd dat de bescherming van de persoonlijke levenssfeer van personen zo veel mogelijk wordt gewaarborgd.

De officier van justitie doet van de bewerking proces-verbaal opmaken, waarin worden vermeld:

a.

een aanduiding van de gegevens waarop de bewerking is uitgevoerd;

b.

een beschrijving van de wijze waarop de bewerking is uitgevoerd;

c.

de feiten en omstandigheden waaruit blijkt dat de voorwaarden, bedoeld in het eerste lid, zijn vervuld.

De officier van justitie ziet er op toe dat zodra de bewerking is voltooid:

a.

uitsluitend de gegevens die het resultaat zijn van de bewerking en van betekenis zijn voor het onderzoek, voor het onderzoek verder worden verwerkt;

b.

de gegevens die het resultaat zijn van de bewerking en niet van betekenis zijn voor het onderzoek en de gegevens die op grond van het eerste lid zijn verkregen en geen deel uitmaken van het resultaat van de bewerking worden vernietigd.

Gegevens als bedoeld in het vijfde lid, onder a, mogen worden verwerkt voor de opsporing van terroristische misdrijven.

7.

De officier van justitie kan in afwijking van het vijfde lid, onder b, bepalen dat de in dat onderdeel bedoelde gegevens niet worden vernietigd voor zover en voor zolang de gegevens nodig zijn om de bewerking achteraf te controleren. Indien de gegevens niet worden vernietigd, worden zij uitsluitend verwerkt om de bewerking achteraf te controleren.
