Letters or other documents to which the duty of confidentiality of persons with the right to decline to testify, as referred to in Articles 218 and 218a, extends, shall not be seized, unless with their consent. The examining magistrate is authorised to decide on this matter.

If the person entitled to privilege objects to the seizure of letters or other documents on the grounds that their duty of confidentiality extends to them, no examination shall take place until the examining magistrate (rechter-commissaris) has ruled on the matter.

The examining magistrate who decides that seizure is permitted shall inform the person entitled to privilege that a complaint against their decision may be lodged with the court of first instance before which the case is being prosecuted, and furthermore that the examination of the seized items shall not proceed until a final and irrevocable decision has been rendered regarding the complaint.

Against the order of the examining magistrate, the person entitled to be excused may, within fourteen days after the service thereof, file a written complaint with the court of first instance before which the case is being prosecuted. Article 552a shall apply.

A search of such persons shall only take place, unless with their consent, insofar as it can be conducted without violation of professional, occupational or official privilege, and shall not extend to letters or documents other than those which constitute the subject matter of the criminal offence or which have served to commit it.

The examining magistrate may, when assessing the plausibility of the claim of the person entitled to professional privilege regarding their duty of confidentiality, be advised by a representative of the professional group to which the person entitled to professional privilege belongs.

Bij personen met bevoegdheid tot verschooning, als bedoeld bij de artikelen 218 en 218a, worden, tenzij met hunne toestemming, niet in beslag genomen brieven of andere geschriften, tot welke hun plicht tot geheimhouding zich uitstrekt. De rechter-commissaris is bevoegd ter zake te beslissen.

Indien de persoon met bevoegdheid tot verschoning bezwaar maakt tegen de inbeslagneming van brieven of andere geschriften omdat zijn plicht tot geheimhouding zich daartoe uitstrekt, wordt niet tot kennisneming overgegaan dan nadat de rechter-commissaris daarover heeft bepaald.

De rechter-commissaris die beslist dat inbeslagneming is toegestaan, deelt de persoon met bevoegdheid tot verschoning mede dat tegen zijn beslissing beklag open staat bij het gerecht in feitelijke aanleg waarvoor de zaak wordt vervolgd en tevens dat niet tot kennisneming wordt overgegaan dan nadat onherroepelijk over het beklag is beslist.

Tegen de beschikking van de rechter-commissaris kan de persoon met bevoegdheid tot verschoning binnen veertien dagen na de betekening daarvan een klaagschrift indienen bij het gerecht in feitelijke aanleg waarvoor de zaak wordt vervolgd. Artikel 552a is van toepassing.

Een doorzoeking vindt bij zodanige personen, tenzij met hun toestemming, alleen plaats voor zover het zonder schending van het stands-, beroeps- of ambtsgeheim kan geschieden, en strekt zich niet uit tot andere brieven of geschriften dan die welke het voorwerp van het strafbare feit uitmaken of tot het begaan daarvan gediend hebben.

De rechter-commissaris kan zich bij de beoordeling van de aannemelijkheid van het beroep van de verschoningsgerechtigde op zijn geheimhoudingsplicht laten voorlichten door een vertegenwoordiger van de beroepsgroep waartoe de verschoningsgerechtigde behoort.
