For the preservation of the right of recourse, the public prosecutor may, on behalf of the State, exercise the powers which are granted in the Civil Code and in the Code of Civil Procedure to a creditor whose possibilities of recourse have been prejudiced as a result of a legal act performed by the debtor without being obliged to do so. Article 94c, under (c) and (e), shall apply mutatis mutandis.

For the application of Articles 46 and 47, Book 3, of the Civil Code, the presumption of knowledge referred to in those articles shall apply to legal acts performed by the suspect or the convicted person within one year prior to the time at which the prosecution against him was commenced.

Furthermore, the public prosecutor is authorised, for the purpose of preserving the right of recovery, to appear on behalf of the State as a creditor in the bankruptcy of the suspect or the convicted person. As long as the amount of the fine or the unlawfully obtained advantage to be confiscated has not yet been determined, he shall be deemed to appear for a conditional claim.

The public prosecutor retains the powers referred to in the first two paragraphs notwithstanding bankruptcy, insofar as the objects to which the non-obligatory legal acts relate are not claimed by the bankruptcy trustee pursuant to Articles 42 up to and including 51 of the Bankruptcy Act (Faillissementswet).

Tot bewaring van het recht tot verhaal kan de officier van justitie namens de staat de bevoegdheden uitoefenen, welke in het Burgerlijk Wetboek en in het Wetboek van Burgerlijke Rechtsvordering zijn toegekend aan een schuldeiser die in zijn verhaalsmogelijkheden is benadeeld als gevolg van een onverplicht door de schuldenaar verrichte rechtshandeling. Artikel 94c, onder c en e, is van overeenkomstige toepassing.

Voor de toepassing van de artikelen 46 en 47, Boek 3, van het Burgerlijk Wetboek geldt het in die artikelen bedoelde vermoeden van wetenschap voor rechtshandelingen welke door de verdachte of veroordeelde zijn verricht binnen één jaar vóór het tijdstip waarop de vervolging tegen hem is aangevangen.

De officier van justitie heeft voorts tot bewaring van het recht tot verhaal de bevoegdheid namens de staat als schuldeiser in het faillissement van de verdachte of veroordeelde op te komen. Zolang het bedrag van de boete of van het te ontnemen wederrechtelijk verkregen voordeel nog niet vaststaat wordt hij geacht voor een voorwaardelijke vordering op te komen.

De officier van justitie behoudt de in de eerste twee leden bedoelde bevoegdheden ondanks faillissement, voor zover de voorwerpen waarop de onverplichte rechtshandelingen betrekking hebben, niet door de curator op grond van de artikelen 42 tot en met 51 van de Faillissementswet worden opgevorderd.
