If only the public prosecution service has lodged an appeal in cassation, the appeal shall be served upon the defendant in person, unless a circumstance has occurred from which it follows that the defendant is aware of the appeal.
The defendant may, within fourteen days after the notice of the appeal by the Public Prosecution Service has been served upon him in person or after any other circumstance has occurred from which it follows that he is aware of the appeal, lodge an appeal in cassation on his own behalf.
If the injured party has joined the proceedings, notice of any appeal in cassation lodged shall be given to said party within fourteen days after the entry thereof by the Public Prosecution Service at the court that rendered the judgment or decree.
Notice of every appeal in cassation shall be given to the victim who has requested such, within fourteen days after this appeal has been lodged. Likewise, notice of every withdrawal of an appeal in cassation shall be given to the victim who has requested such, within fourteen days after this appeal has been withdrawn.
Indien alleen het openbaar ministerie beroep in cassatie heeft ingesteld, wordt het beroep aan de verdachte in persoon aangezegd, tenzij zich een omstandigheid heeft voorgedaan waaruit voortvloeit dat het beroep de verdachte bekend is.
De verdachte kan binnen veertien dagen nadat aan hem de aanzegging van het beroep door het openbaar ministerie in persoon is betekend of zich enige andere omstandigheid heeft voorgedaan, waaruit voortvloeit dat het beroep hem bekend is, zijnerzijds alsnog beroep in cassatie instellen.
Indien de benadeelde partij zich in het geding gevoegd heeft, wordt haar van elk ingesteld beroep in cassatie, binnen veertien dagen na de aantekening vanwege het openbaar ministerie bij het gerecht dat het vonnis of arrest heeft gewezen, kennis gegeven.
Van elk ingesteld beroep in cassatie wordt kennisgegeven aan het slachtoffer dat daarom verzoekt, binnen veertien dagen nadat dit beroep is ingesteld. Eveneens wordt van elke intrekking van een beroep in cassatie kennisgegeven aan het slachtoffer dat daarom verzoekt, binnen veertien dagen nadat dit beroep is ingetrokken.
