The order issued by the examining magistrate pursuant to Article 226a, paragraph 1, shall be reasoned, dated, and signed, and shall be notified in writing without delay to the public prosecutor and served upon the suspect and the witness, stating the time limit within which and the manner in which the legal remedy available against the order must be lodged.

The public prosecutor may lodge an appeal against the order within fourteen days of the date of the order, and the suspect and the witness may lodge an appeal within fourteen days of the service thereof, to the court of first instance where the case is being prosecuted.

The court shall decide as soon as possible. If the appeal against an order issued in accordance with Article 226a, paragraph 1, is found to be well-founded and the examining magistrate has already examined the witness in compliance with Articles 226c-226f, the examining magistrate shall ensure that the official report of the examination of the witness is destroyed. The examining magistrate shall draw up an official report of this action. Article 226f shall apply mutatis mutandis.

No appeal in cassation may be lodged against the order of the court.

If it has been irrevocably decided in appeal proceedings that the witness is a threatened witness, the members of the court shall not participate in the trial proceedings, on pain of nullity. Article 21, paragraph 3, shall not apply.

De ingevolge artikel 226a, eerste lid, gegeven beschikking van de rechter-commissaris is met redenen omkleed, gedagtekend en ondertekend en wordt onverwijld schriftelijk ter kennis gebracht van de officier van justitie en betekend aan de verdachte en de getuige, met vermelding van de termijn waarbinnen en de wijze waarop het rechtsmiddel, dat tegen de beschikking openstaat, moet worden ingesteld.

Tegen de beschikking staat voor de officier van justitie binnen veertien dagen na de dagtekening van de beschikking en voor de verdachte en de getuige binnen veertien dagen na de betekening daarvan hoger beroep open bij het gerecht in feitelijke aanleg, waarvoor de zaak wordt vervolgd.

Het gerecht beslist zo spoedig mogelijk. Indien het hoger beroep tegen een overeenkomstig artikel 226a, eerste lid, gegeven bevel gegrond wordt geoordeeld en de rechter-commissaris de getuige reeds met inachtneming van de artikelen 226c-226f heeft verhoord, draagt de rechter-commissaris zorg dat het proces-verbaal van verhoor van de getuige wordt vernietigd. De rechter-commissaris maakt hiervan proces-verbaal op. Artikel 226f is van overeenkomstige toepassing.

Tegen de beschikking van het gerecht is beroep in cassatie niet toegelaten.

Indien in hoger beroep onherroepelijk is beslist dat de getuige een bedreigde getuige is, nemen de leden van het gerecht, op straffe van nietigheid, niet aan het onderzoek ter terechtzitting deel. Artikel 21, derde lid, blijft buiten toepassing.
