The examining magistrate shall examine the witness whose examination is deemed desirable by him, is ordered by the court, or is requested by the public prosecutor. He may order the summoning of said witness.
The public prosecutor may, by a reasoned decision, refuse to execute an order for summons issued by the examining magistrate as referred to in the first paragraph, if the public prosecutor has promised the witness that they will not be heard in any other capacity than as a threatened witness or as a shielded witness whose identity is kept hidden. After having notified the examining magistrate and the suspect of the refusal without delay and in writing, the public prosecutor shall, if they have not already done so, submit the application referred to in Article 226a, first paragraph, or Article 226m, first paragraph.
The second paragraph shall not apply in the event of a summons of the witness as a threatened witness or as a protected witness whose identity is kept concealed.
De rechter-commissaris verhoort den getuige, wiens verhoor door hem wenschelijk wordt geoordeeld, door den rechter wordt bevolen of door den officier van justitie wordt gevorderd. Hij kan diens dagvaarding bevelen.
De officier van justitie kan bij met redenen omklede beslissing weigeren een bevel van de rechter-commissaris tot dagvaarding als bedoeld in het eerste lid ten uitvoer te leggen, indien de officier van justitie de getuige heeft toegezegd dat hij op geen andere wijze dan als bedreigde getuige of als afgeschermde getuige wiens identiteit verborgen wordt gehouden, zal worden gehoord. Na de weigering onverwijld en schriftelijk ter kennis van de rechter-commissaris en de verdachte te hebben gebracht, dient de officier van justitie, indien hij zulks nog niet heeft gedaan, de vordering, bedoeld in artikel 226a, eerste lid, of artikel 226m, eerste lid, in.
Het tweede lid blijft buiten toepassing in geval van dagvaarding van de getuige als bedreigde getuige of als afgeschermde getuige wiens identiteit verborgen wordt gehouden.
