The Public Prosecution Service may revoke the certificate upon the order of the court, as referred to in Article 5.7.16, paragraph 3, following:
the notification regarding the maximum period during which compliance with the conditions attached to the suspension of pre-trial detention may be supervised in the executing Member State;
the notification regarding the decision of the competent authority of the executing Member State to amend the conditions attached to the suspension of pre-trial detention.
The Public Prosecution Service shall decide on the withdrawal of the certificate within a period of ten days after receipt of the notification referred to in the first paragraph. The Public Prosecution Service shall notify the competent authority of the executing Member State and the suspect of the decision to withdraw the certificate in writing and stating the reasons therefor without delay.
Het openbaar ministerie kan het certificaat intrekken in opdracht van de rechter, bedoeld in artikel 5.7.16, derde lid, naar aanleiding van:
de kennisgeving betreffende de maximumtermijn gedurende welke in de uitvoerende lidstaat toezicht kan worden gehouden op de naleving van de aan de schorsing van de voorlopige hechtenis verbonden voorwaarden;
de kennisgeving betreffende de beslissing van de bevoegde autoriteit van de uitvoerende lidstaat tot aanpassing van de aan de schorsing van de voorlopige hechtenis verbonden voorwaarden.
Het openbaar ministerie beslist over de intrekking van het certificaat binnen een termijn van tien dagen na ontvangst van de kennisgeving, bedoeld in het eerste lid. Het openbaar ministerie stelt de bevoegde autoriteit van de uitvoerende lidstaat en de verdachte onverwijld schriftelijk en met redenen omkleed in kennis van de beslissing om het certificaat in te trekken.
