Article 281

Any person guilty of abduction shall be punished as follows:
punishable by a term of imprisonment not exceeding six years or a fine of the fourth category is he who abducts a minor female, without the consent of her parents or guardians but with her consent, with the intent to secure possession of her in or outside of marriage;
Any person who, by means of deceit, violence or threat of violence, abducts a woman with the intent to secure possession of her in or out of marriage, shall be punished with a term of imprisonment not exceeding nine years or a fine of the fifth category.
No prosecution shall take place other than upon a complaint.
The complaint shall be lodged:
if the woman is a minor at the time of the abduction, whether by herself or by someone whose consent she requires for the solemnisation of the marriage;
if she is of age at the time of the abduction, either by herself or by her spouse.
If the abductor has entered into a marriage with the abducted person, no conviction shall take place until the nullity of the marriage has been pronounced.
Als schuldig aan schaking wordt gestraft:
met gevangenisstraf van ten hoogste zes jaren of geldboete van de vierde categorie, hij die een minderjarige vrouw, zonder de wil van haar ouders of voogden doch met haar toestemming, wegvoert, met het oogmerk om zich haar bezit in of buiten echt te verzekeren;
met gevangenisstraf van ten hoogste negen jaren of geldboete van de vijfde categorie, hij die een vrouw door list, geweld of bedreiging met geweld wegvoert, met het oogmerk om zich haar bezit in of buiten echt te verzekeren.
Geen vervolging heeft plaats dan op klacht.
De klacht geschiedt:
indien de vrouw tijdens de wegvoering minderjarig is, hetzij door haarzelf, hetzij door iemand wiens toestemming zij tot het aangaan van een huwelijk behoeft;
indien zij tijdens de wegvoering meerderjarig is, hetzij door haarzelf, hetzij door haar echtgenoot.
Indien de schaker met de weggevoerde een huwelijk heeft gesloten, heeft geen veroordeling plaats, dan nadat de nietigheid van het huwelijk is uitgesproken.
