Article 226
in forceForgery of documents, provision of false information and breach of the obligation to provide information
The person guilty of forgery of documents shall be punished by a term of imprisonment not exceeding seven years or a fine of the fifth category, if it has been committed:
in authentic deeds;
in promissory notes or certificates of debt of any state, any province, municipality or public institution;
in shares or debentures or depositary receipts for shares or debt of any association, foundation or company;
in talons, dividend or interest coupons pertaining to one of the documents described under the two preceding numbers, or in the certificates issued in place of these documents;
in credit or commercial paper.
The same penalty shall be imposed on any person who intentionally makes use of any false or falsified document referred to in the first paragraph as if it were genuine and unfalsified, or who intentionally delivers, has in their possession, receives, procures, transports, sells, or transfers such a document, while knowing or reasonably suspecting that this document is intended for such use.
De schuldige aan valsheid in geschrift wordt gestraft met gevangenisstraf van ten hoogste zeven jaren of geldboete van de vijfde categorie, indien zij gepleegd is:
in authentieke akten;
in schuldbrieven of certificaten van schuld van enige staat, enige provincie, gemeente of openbare instelling;
in aandelen of schuldbrieven of certificaten van aandeel of schuld van enige vereniging, stichting of vennootschap;
in talons, dividend- of rentebewijzen behorende tot een der onder de beide voorgaande nummers omschreven stukken, of in de bewijzen in plaats van deze stukken uitgegeven;
in krediet- of handelspapier.
Met dezelfde straf wordt gestraft hij die opzettelijk gebruik maakt van enig in het eerste lid vermeld vals of vervalst geschrift als ware het echt en onvervalst, dan wel opzettelijk zodanig geschrift aflevert, voorhanden heeft, ontvangt, zich verschaft, vervoert, verkoopt of overdraagt, terwijl hij weet of redelijkerwijs moet vermoeden dat dit geschrift bestemd is voor zodanig gebruik.
