Article 161quinquies
in forceFiling and withdrawal of the complaint in cases of offences punishable only upon complaint
He to whose fault it is attributable that persons, animals, plants or goods are exposed to ionizing radiation, or that persons, animals, plants, goods, soil, water or air are contaminated with radioactive substances, shall be punished:
by a term of imprisonment not exceeding one year or a fine of the fourth category, if there is a risk of danger to public health or danger to the life of another person;
by a term of imprisonment not exceeding two years or a fine of the fourth category, if there is a risk of danger to the life of another person and the act results in the death of a person.
Hij aan wiens schuld te wijten is dat mensen, dieren, planten of goederen aan ioniserende stralen worden blootgesteld, dan wel mensen, dieren, planten, goederen, bodem, water of lucht met radioactieve stoffen worden besmet, wordt gestraft:
met gevangenisstraf van ten hoogste een jaar of geldboete van de vierde categorie, indien daarvan gevaar voor de openbare gezondheid of levensgevaar voor een ander te duchten is;
met gevangenisstraf van ten hoogste twee jaren of geldboete van de vierde categorie, indien daarvan levensgevaar voor een ander te duchten is en het feit iemands dood ten gevolge heeft.
