The drawee is deemed to have the necessary funds in hand if, upon presentation of the cheque, he owes to the drawer or to the person for whose account it was drawn a due and payable sum at least equal to the amount of the cheque.
De betrokkene wordt geacht, het noodige fonds in handen te hebben, indien hij bij de aanbieding van de chèque aan den trekker of aan dengene voor wiens rekening is getrokken, een opeischbare som schuldig is, ten minste gelijkstaande met het beloop van de chèque.
