The drawer, or the person for whose account the cheque is drawn, is obliged to ensure that the necessary funds for payment are in the hands of the drawee on the day of presentment, even if the cheque is made payable at a third party, without prejudice to the obligation of the drawer in accordance with Article 189.
De trekker, of degene voor wiens rekening de chèque is getrokken, is verplicht zorg te dragen dat het noodige fonds tot betaling op den dag der aanbieding in handen van den betrokkene zij, zelfs indien de chèque bij eenen derde is betaalbaar gesteld, onverminderd de verplichting van den trekker overeenkomstig artikel 189.
