When the presentment of the bill of exchange or the drawing up of the protest within the prescribed time limits is prevented by an insurmountable obstacle (legal provision of any State or other case of force majeure), these time limits are extended.

The holder is obliged to give notice of the force majeure without delay to his endorser, and to record this notice, dated and signed, on the bill of exchange or on an allonge; for the rest, the provisions of Article 144 are applicable.

After the cessation of the force majeure, the holder must without delay present the bill of exchange for acceptance or for payment and, if there is reason to do so, cause a protest to be drawn up.

If the force majeure continues for more than thirty days, calculated from the date of maturity, the right of recourse may be exercised without presentment or the drawing up of a protest being necessary.

For bills of exchange drawn at sight or at a fixed period after sight, the period of thirty days runs from the day on which the holder, even if it were before the end of the period for presentation, has given notice of the force majeure to his endorser; for bills of exchange drawn at a fixed period after sight, the period of thirty days is extended by the sight period indicated in the bill of exchange.

Facts which are of a purely personal nature for the holder, or for the person whom he entrusted with the presentment of the bill of exchange or with the drawing up of the protest, are not considered as cases of force majeure.

Wanneer de aanbieding van den wisselbrief of het opmaken van het protest binnen de voorgeschreven termijnen wordt verhinderd door een onoverkomelijk beletsel (wettelijk voorschrift van eenigen Staat of ander geval van overmacht), worden deze termijnen verlengd.

De houder is verplicht, van de overmacht onverwijld aan zijnen endossant kennis te geven, en deze kennisgeving gedagteekend en onderteekend op den wisselbrief of op een verlengstuk te vermelden; voor het overige zijn de bepalingen van artikel 144 toepasselijk.

3.

Na het ophouden van de overmacht moet de houder onverwijld den wisselbrief ter acceptatie of ter betaling aanbieden en, indien daartoe aanleiding bestaat, protest doen opmaken.

4.

Indien de overmacht meer dan dertig dagen, te rekenen van den vervaldag, aanhoudt, kan het recht van regres worden uitgeoefend, zonder dat de aanbieding of het opmaken van protest noodig is.

5.

Voor wisselbrieven, getrokken op zicht of op zekeren tijd na zicht, loopt de termijn van dertig dagen van den dag, waarop de houder, al ware het vóór het einde van den aanbiedingstermijn, van de overmacht aan zijnen endossant heeft kennis gegeven; voor wisselbrieven, getrokken op zekeren tijd na zicht, wordt de termijn van dertig dagen verlengd met den zichttermijn, in den wisselbrief aangegeven.

Feiten, welke voor den houder, of voor dengene, dien hij met de aanbieding van den wisselbrief of met het opmaken van het protest belastte, van zuiver persoonlijken aard zijn, worden niet beschouwd als gevallen van overmacht.
