Set-off of losses

If the calculation of the taxable profit or of the Dutch income results in a negative amount, this shall be designated as a loss.

A loss shall be set off against the taxable profits, or the Dutch income, respectively, of the preceding year and the subsequent years, provided that the loss has been established by the inspector by means of an appealable decision. In this regard, set-off in a year shall only take place up to an amount of € 1,000,000 increased by 50% of the taxable profit, or the Dutch income, respectively, of that year after that profit, or that income, respectively, has been reduced by an amount of € 1,000,000.

By way of derogation from the second paragraph, losses incurred during a period in which a taxpayer is designated as an investment institution (status period) are not deductible from taxable profits or, as the case may be, Dutch income, derived outside the status period, and losses incurred outside the status period are not deductible from profits or, as the case may be, Dutch income, derived within the status period.

The set-off shall take place in the order in which the losses were incurred and the taxable profits were made or the Dutch incomes were derived.

For a taxpayer who has been granted an exemption from one or more national insurance schemes on the grounds of conscientious objections as referred to in Article 64, first paragraph, opening words and part b, of the Financing of Social Insurance Act, and who opts for this in the tax return, the period for the carry-back of losses mentioned in the second paragraph shall, for losses referred to in the sixth paragraph, be replaced by three years.

The fifth paragraph applies to losses attributable to costs and charges of damage resulting from risks that other taxpayers who, in terms of the nature and scope of business activities, are in a comparable position to the taxpayer, customarily insure.

Indien de berekening van de belastbare winst of van het Nederlandse inkomen leidt tot een negatief bedrag, wordt dit aangemerkt als een verlies.

Een verlies wordt verrekend met de belastbare winsten, onderscheidenlijk de Nederlandse inkomens, van het voorafgaande jaar en de volgende jaren, mits het verlies door de inspecteur is vastgesteld bij voor bezwaar vatbare beschikking. Daarbij vindt verrekening in een jaar slechts plaats tot een bedrag van € 1.000.000 vermeerderd met 50% van de belastbare winst, onderscheidenlijk het Nederlandse inkomen, van dat jaar nadat die winst, onderscheidenlijk dat inkomen, is verminderd met een bedrag van € 1.000.000.

In afwijking van het tweede lid zijn de verliezen geleden in een periode waarin een belastingplichtige als beleggingsinstelling is aangemerkt (statusperiode), niet verrekenbaar met de belastbare winsten, onderscheidenlijk Nederlandse inkomens, die buiten de statusperiode zijn genoten, en zijn verliezen die buiten de statusperiode zijn geleden niet verrekenbaar met de winsten, onderscheidenlijk Nederlandse inkomens, die binnen de statusperiode zijn genoten.

De verrekening geschiedt in de volgorde waarin de verliezen zijn ontstaan en de belastbare winsten zijn gemaakt of de Nederlandse inkomens zijn genoten.

De in het tweede lid genoemde termijn voor de achterwaartse verliesverrekening wordt voor een belastingplichtige aan wie wegens gemoedsbezwaren tegen één of meer volksverzekeringen ontheffing is verleend als bedoeld in artikel 64, eerste lid, aanhef en onderdeel b, van de Wet financiering sociale verzekeringen, en hij daarvoor bij de aangifte kiest, voor in het zesde lid bedoelde verliezen vervangen door drie jaar.

Het vijfde lid is van toepassing op verliezen die zijn toe te rekenen aan kosten en lasten van schade als gevolg van risico's die andere belastingplichtigen die wat betreft aard en omvang van de bedrijfsactiviteiten in een vergelijkbare positie verkeren als de belastingplichtige, plegen te verzekeren.
