Article 2:39

This Section applies in the event of the formation of an SCE by at least two legal entities or by conversion.
In the event of the formation of an SCE exclusively by natural persons or by only one legal entity and natural persons, this section shall apply mutatis mutandis if the total number of employees of the SCE and its subsidiaries and establishments in at least two Member States amounts to at least 50.
Article 2:7, paragraph 2, shall apply mutatis mutandis.
Deze afdeling is van toepassing in het geval van oprichting van een SCE door ten minste twee juridische lichamen of door omzetting.
In het geval van oprichting van een SCE door uitsluitend natuurlijke personen of door slechts één juridisch lichaam en natuurlijke personen, is deze afdeling van overeenkomstige toepassing, indien het totale aantal werknemers van de SCE en haar dochterondernemingen en vestigingen in ten minste twee lidstaten ten minste 50 zal bedragen.
Artikel 2:7, tweede lid, is van overeenkomstige toepassing.
