Article 2:38

If, after the registration of an SCE as referred to in Article 2:36,
at least one-third of the total number of employees of the SCE and of its subsidiaries and establishments in at least two different Member States submits a petition to this effect, or
the total number of employees of the SCE and of its subsidiaries and establishments in at least two Member States amounts to 50 or more, Sections 2 and 3 of this Chapter shall apply mutatis mutandis, on the understanding that the obligations incumbent upon the participating legal entities and the concerned subsidiaries and establishments under those Sections shall relate to the SCE and the subsidiaries and establishments of the SCE, respectively.
Indien na de inschrijving van een SCE als bedoeld in artikel 2:36,
ten minste eenderde van het totale aantal werknemers van de SCE en van haar dochterondernemingen en vestigingen in ten minste twee verschillende lidstaten hierom verzoekt, of
het totale aantal werknemers van de SCE en van haar dochterondernemingen en vestigingen in ten minste twee lidstaten 50 of meer bedraagt, zijn de afdelingen 2 en 3 van dit hoofdstuk van overeenkomstige toepassing, met dien verstande dat verplichtingen die krachtens die afdelingen rusten op de deelnemende juridische lichamen en betrokken dochterondernemingen en vestigingen, betrekking hebben op de SCE respectievelijk dochterondernemingen en vestigingen van de SCE.
