The board of the Arnhem-Leeuwarden Court of Appeal shall constitute a multi-judge chamber, designated as the military chamber, for the purpose of hearing and deciding cases in which judgment has been rendered by the military chamber of the Gelderland District Court. The board shall determine the composition of this chamber.
The military chamber consists of two judicial officers charged with the administration of justice and one military member, who preferably belongs to the branch of the armed forces to which the defendant belongs or belonged. In the hearing of a case against defendants from different branches of the armed forces, the presiding judge of the chamber shall determine from which branch of the armed forces the military member shall be drawn. Articles 7, paragraph 3, 12, and 13 up to and including 13g apply mutatis mutandis to the military member. Furthermore, Articles 44, paragraphs 1, 4 up to and including 8, and 10, and 44a, paragraphs 1 up to and including 8, and 10, of the Legal Status of Judicial Officers Act (Wet rechtspositie rechterlijke ambtenaren) apply mutatis mutandis to this member, with the understanding that the board of the court is designated as his functional authority, that for the purposes of the mutatis mutandis application of Article 44, paragraphs 1 and 7, this member is equated with deputy judges in the same court, and that the president of the court exercises the authority referred to in Article 44, paragraph 6, with respect to this member.
The military chamber also adjudicates on complaints regarding non-prosecution in military cases as referred to in Article 12 of the Code of Criminal Procedure.
Het bestuur van het gerechtshof Arnhem-Leeuwarden vormt voor het behandelen en beslissen van zaken waarin door de militaire kamer van de rechtbank Gelderland vonnis is gewezen een meervoudige kamer onder de benaming van militaire kamer. Het bestuur bepaalt de bezetting van deze kamer.
De militaire kamer bestaat uit twee rechterlijke ambtenaren met rechtspraak belast en een militair lid, dat bij voorkeur behoort tot het krijgsmachtdeel waartoe de verdachte behoort of behoorde. Bij de behandeling van een zaak tegen verdachten van verschillende krijgsmachtdelen bepaalt de voorzitter van de kamer uit welk krijgsmachtdeel het militaire lid afkomstig is. Op het militaire lid zijn de artikelen 7, derde lid, 12 en 13 tot en met 13g van overeenkomstige toepassing. Tevens zijn de artikelen 44, eerste, vierde tot en met achtste en tiende lid, en 44a, eerste tot en met achtste en tiende lid, van de Wet rechtspositie rechterlijke ambtenaren op dit lid van overeenkomstige toepassing, met dien verstande dat het bestuur van het gerecht wordt aangemerkt als zijn functionele autoriteit, dit lid voor de overeenkomstige toepassing van artikel 44, eerste en zevende lid, wordt gelijkgesteld met plaatsvervangers in hetzelfde gerecht, en de president van het gerecht ten aanzien van dit lid de bevoegdheid, bedoeld in artikel 44, zesde lid, uitoefent.
De militaire kamer oordeelt ook over het beklag over niet vervolging in militaire zaken als bedoeld in artikel 12 van het Wetboek van Strafvordering.
