Any person working in the enterprise, with the exception of a person as referred to in Article 35b, paragraph 8, as well as an association of employees which counts one or more persons working in the enterprise among its members, which has as its object under its articles of association to promote the interests of its members as employees and is active as such in the enterprise or branch of industry concerned, and which furthermore has possessed full legal capacity for at least two years, may petition the subdistrict court to determine that the entrepreneur must comply with Article 35b.
Iedere in de onderneming werkzame persoon, met uitzondering van een persoon als bedoeld in artikel 35b, achtste lid, alsmede een vereniging van werknemers, die één of meer in de onderneming werkzame personen onder haar leden telt, die krachtens haar statuten ten doel heeft de belangen van haar leden als werknemers te behartigen en als zodanig in de betrokken onderneming of bedrijfstak werkzaam is en voorts tenminste twee jaar in het bezit is van volledige rechtsbevoegdheid, kan de kantonrechter verzoeken te bepalen dat de ondernemer gevolg dient te geven aan artikel 35b.
