Articles 23, paragraph 2, second sentence, and 31d are not applicable to:
the private company with limited liability of which one of the directors or supervisory directors is a natural person who has a direct or indirect interest in the legal entity in accordance with Article 4.6 of the Income Tax Act 2001, or
the legal entity to which the provisions of Articles 396 or 397 of Title 9 of Book 2 of the Civil Code apply.
De artikelen 23, tweede lid, tweede zin, en 31d zijn niet van toepassing op:
de besloten vennootschap met beperkte aansprakelijkheid waarvan een van de bestuurders of commissarissen een natuurlijk persoon is die een direct of indirect belang heeft in de rechtspersoon overeenkomstig artikel 4.6 van de Wet inkomstenbelasting 2001, of
de rechtspersoon waarop de artikelen 396 of 397 van titel 9 van Boek 2 van het Burgerlijk Wetboek van toepassing zijn.
