The entrepreneur shall, partly for the purpose of discussing the general state of affairs of the enterprise, provide the works council at least once a year with written information regarding the level and content of the terms and conditions of employment regulations and agreements for each different group of persons working in the enterprise.
In addition, the entrepreneur shall provide written information regarding the level and content of the employment terms and conditions and agreements with the board representing the legal entity, as well as the total remuneration provided to the supervisory body referred to in Article 24, paragraph 2.
With regard to the first and second paragraphs, it shall be made transparent what percentage these terms and conditions of employment and agreements bear to one another and to those of the preceding year.
If a group, as referred to in the first paragraph, the management board or the supervisory body, referred to in the second paragraph, consists of fewer than five persons, it is possible for the application of these paragraphs to combine two or more functions, so that a group of at least five persons is formed.
The entrepreneur is obliged to inform the works council as soon as possible of any significant changes made to these regulations and agreements.
This article applies exclusively to undertakings in which, as a rule, at least 100 persons are employed.
De ondernemer verstrekt, mede ten behoeve van de bespreking van de algemene gang van zaken van de onderneming, ten minste eenmaal per jaar aan de ondernemingsraad schriftelijk informatie over de hoogte en inhoud van de arbeidsvoorwaardelijke regelingen en afspraken per verschillende groep van de in de onderneming werkzame personen.
De ondernemer verstrekt daarbij tevens schriftelijke informatie over de hoogte en inhoud van de arbeidsvoorwaardelijke regelingen en afspraken met het bestuur dat de rechtspersoon vertegenwoordigt en het totaal van de vergoedingen, dat wordt verstrekt aan het toezichthoudend orgaan, bedoeld in artikel 24, tweede lid.
Ten aanzien van het eerste en tweede lid wordt inzichtelijk gemaakt met welk percentage deze arbeidsvoorwaardelijke regelingen en afspraken zich verhouden tot elkaar en tot die van het voorgaande jaar.
Indien een groep, als bedoeld in het eerste lid, het bestuur of het toezichthoudend orgaan, bedoeld in het tweede lid, uit minder dan vijf personen bestaat, is het mogelijk om voor de toepassing van deze leden twee of meer functies samen te voegen, zodat een groep van ten minste vijf personen ontstaat.
De ondernemer is verplicht de ondernemingsraad zo spoedig mogelijk in kennis te stellen van belangrijke wijzigingen die in deze regelingen en afspraken worden aangebracht.
Dit artikel is uitsluitend van toepassing op ondernemingen waarin in de regel ten minste 100 personen werkzaam zijn.
