The costs that are reasonably necessary for the performance of the duties of the works council and the committees of that council shall be borne by the entrepreneur.
Subject to the provisions of the first paragraph, the costs of consulting an expert by the works council or a committee of that council in accordance with Article 16 and Article 23a, sixth paragraph, as well as the costs of conducting legal proceedings by the works council, shall only be borne by the entrepreneur if he has been notified in advance of the costs to be incurred. The first sentence shall not apply when the fourth paragraph has been implemented.
With due observance of the first paragraph, the costs of education and training, as referred to in Article 18, paragraph 2, shall be borne by the entrepreneur. The Council may establish standard amounts for various costs associated with education and training.
The entrepreneur may, in agreement with the works council, determine the costs that the works council and the committees of that council will incur in any given year, insofar as these do not relate to Articles 17 and 18, paragraph 1, at a specific amount which the works council may spend at its own discretion. Costs that would cause the amount referred to here to be exceeded shall only be borne by the entrepreneur insofar as he consents to bearing them.
De kosten die redelijkerwijze noodzakelijk zijn voor de vervulling van de taak van de ondernemingsraad en de commissies van die raad komen ten laste van de ondernemer.
Met inachtneming van het bepaalde in het eerste lid komen de kosten van het overeenkomstig artikel 16 en artikel 23a, zesde lid, raadplegen van een deskundige door de ondernemingsraad of een commissie van die raad, alsmede de kosten van het voeren van rechtsgedingen door de ondernemingsraad slechts ten laste van de ondernemer, indien hij van de te maken kosten vooraf in kennis is gesteld. De eerste volzin is niet van toepassing wanneer uitvoering is gegeven aan het vierde lid.
Met inachtneming van het eerste lid komen de kosten van scholing en vorming, bedoeld in artikel 18, tweede lid, ten laste van de ondernemer. De Raad kan voor verschillende kosten verbonden aan scholing en vorming richtbedragen vaststellen.
De ondernemer kan in overeenstemming met de ondernemingsraad de kosten die de ondernemingsraad en de commissies van die raad in enig jaar zullen maken, voor zover deze geen verband houden met artikel artikelen 17 en 18, eerste lid, vaststellen op een bepaald bedrag, dat de ondernemingsraad naar eigen inzicht kan besteden. Kosten waardoor het hier bedoelde bedrag zou worden overschreden, komen slechts ten laste van de ondernemer voor zover hij in het dragen daarvan toestemt.
