The entrepreneur who maintains an enterprise in which, as a rule, at least 50 persons are employed, is, in the interest of the proper functioning of that enterprise in all its objectives, obliged to establish a works council for the purpose of consultation with and representation of the persons employed in the enterprise, and to comply with the regulations laid down by or pursuant to this Act with regard to this council.
If, in an enterprise, after the establishment of a works council, at least 50 persons are no longer as a rule employed, the works council shall cease to exist by operation of law upon the expiration of the current term of office of that council, unless the entrepreneur applies Article 5a, paragraph 2.
De ondernemer die een onderneming in stand houdt waarin in de regel ten minste 50 personen werkzaam zijn, is in het belang van het goed functioneren van die onderneming in al haar doelstellingen verplicht om ten behoeve van het overleg met en de vertegenwoordiging van de in de onderneming werkzame personen een ondernemingsraad in te stellen en jegens deze raad de voorschriften, gesteld bij of krachtens deze wet, na te leven.
Indien in een onderneming na de instelling van een ondernemingsraad niet langer in de regel ten minste 50 personen werkzaam zijn, houdt de ondernemingsraad van rechtswege op te bestaan bij het eindigen van de lopende zittingsperiode van die raad, tenzij de ondernemer toepassing geeft aan artikel 5a, tweede lid.
