For the purposes of this Act and the provisions based thereon, the following definitions shall apply:

labour migrant: a national of another Member State of the European Union who does not have his principal residence in the Netherlands and who resides in the Netherlands for the purpose of performing temporary work;

administrator: the mayor and aldermen or a person designated by them:

a natural or legal person other than the lessor who is professionally or commercially active in the field of housing, and to whom a permit as referred to in Article 5, paragraph 1, has been or can be granted;

approved institution; or

subsidiary

subsidiary: a subsidiary of an approved institution as referred to in Article 1, paragraph 2, of the Housing Act (Woningwet);

building: building as referred to in Article 1, paragraph 1, of the Housing Act (Woningwet);

approved institution: an approved institution as referred to in Article 19 of the Housing Act (Woningwet);

rental agent: a natural or legal person who, as the agent (lasthebber) referred to in Article 414, paragraph 1, of Book 7 of the Civil Code, performs acts on behalf of the lessor in order to conclude a rental agreement for residential or accommodation space;

accommodation: a building or part of a building that is intended for or used for the housing of migrant workers;

lessor: a lessor who is not an approved institution (toegelaten instelling) or a subsidiary;

rental ordinance: rental ordinance as referred to in Article 5, paragraph 1;

housing discrimination: acting in violation of Article 7 of the General Equal Treatment Act or Section 3a of the Equal Treatment on the Grounds of Disability or Chronic Illness Act when offering or letting residential or accommodation space;

living accommodation: an enclosed space which, whether or not together with one or more other spaces, is intended or suitable for habitation, as well as a plot intended for the placement of a residential caravan, on which facilities are present that can be connected to the mains of public utility companies, other institutions or municipalities.

In deze wet en de daarop berustende bepalingen wordt verstaan onder:

arbeidsmigrant: onderdaan van een andere lidstaat van de Europese Unie die zijn hoofdverblijf niet in Nederland heeft en in Nederland verblijft om tijdelijke werkzaamheden te verrichten;

beheerder: burgemeester en wethouders of een door hen aangewezen:

andere natuurlijke of rechtspersoon dan de verhuurder die uit hoofde van beroep of bedrijf op het terrein van de huisvesting werkzaam is, en aan wie een vergunning als bedoeld in artikel 5, eerste lid, is of kan worden verleend;

toegelaten instelling; of

dochtermaatschappij;

dochtermaatschappij: dochtermaatschappij van een toegelaten instelling als bedoeld in artikel 1, tweede lid, van de Woningwet;

gebouw: gebouw als bedoeld in artikel 1, eerste lid, van de Woningwet;

toegelaten instelling: toegelaten instelling als bedoeld in artikel 19 van de Woningwet;

verhuurbemiddelaar: natuurlijke of rechtspersoon die als de lasthebber, bedoeld in artikel 414, eerste lid, van Boek 7 van het Burgerlijk Wetboek, namens de verhuurder handelingen verricht om een overeenkomst van huur van een woon- of verblijfsruimte tot stand te brengen;

verblijfsruimte: gebouw of deel van een gebouw dat bestemd is of gebruikt wordt voor de huisvesting van arbeidsmigranten;

verhuurder: verhuurder niet zijnde een toegelaten instelling of een dochtermaatschappij;

verhuurverordening: verhuurverordening als bedoeld in artikel 5, eerste lid;

woondiscriminatie: het bij het aanbieden of verhuren van woon- of verblijfsruimte handelen in strijd met artikel 7 van de Algemene wet gelijke behandeling of met paragraaf 3a van de Wet gelijke behandeling op grond van handicap of chronische ziekte;

woonruimte: besloten ruimte die, al dan niet tezamen met een of meer andere ruimten, bestemd of geschikt is voor bewoning, alsmede een kavel die bestemd is voor het plaatsen van een woonwagen, waarop voorzieningen aanwezig zijn die op het leidingnet van de openbare nutsbedrijven, andere instellingen of van gemeenten kunnen worden aangesloten.
