No later than four years after its establishment, the European Works Council shall decide, whether or not upon a proposal from the central management, whether it is desirable to enter into negotiations with the central management regarding the conclusion of an agreement as referred to in Article 8, paragraph 1.
Articles 11, paragraphs 3 up to and including 6, and 13, paragraphs 1 and 3, shall apply mutatis mutandis, on the understanding that the European Works Council shall replace the special negotiating body for this purpose.
Uiterlijk vier jaar na zijn instelling besluit de Europese ondernemingsraad, al dan niet op voorstel van het hoofdbestuur, of het wenselijk is met het hoofdbestuur in onderhandeling te treden over het sluiten van een overeenkomst als bedoeld in artikel 8, eerste lid.
De artikelen 11, derde tot en met zesde lid, en 13, eerste en derde lid, zijn van overeenkomstige toepassing, met dien verstande dat de Europese ondernemingsraad hierbij in de plaats treedt van de bijzondere onderhandelingsgroep.
