Article 10
in forceThe officials of the Health and Youth Care Inspectorate (Inspectie gezondheidszorg en jeugd) are charged with the supervision of compliance with the provisions of or pursuant to this Act.
The powers vested in the officials referred to in the first paragraph, as provided for in Articles 5:16 and 5:17 of the General Administrative Law Act (Algemene wet bestuursrecht), shall also relate to the data referred to in Articles 1a, 2, first or second paragraph, or 12a, third paragraph.
Insofar as the performer or the Board is obliged to maintain confidentiality of the data by virtue of office, profession, or statutory provision, that person may not, in deviation from Article 5:20, second paragraph, of the General Administrative Law Act (Algemene wet bestuursrecht), invoke this obligation against the officials referred to in the first paragraph. These officials shall be subject to the same duty of confidentiality as the performer or the Board.
Met het toezicht op de naleving van het bepaalde bij of krachtens deze wet zijn belast de ambtenaren van de Inspectie gezondheidszorg en jeugd.
De aan de in het eerste lid bedoelde ambtenaren toekomende bevoegdheden, bedoeld in de artikelen 5:16 en 5:17 van de Algemene wet bestuursrecht, hebben mede betrekking op de gegevens, bedoeld in de artikelen 1a, 2, eerste of tweede lid, of 12a, derde lid.
Voor zover de verrichter dan wel het College uit hoofde van ambt, beroep of wettelijk voorschrift tot geheimhouding van de gegevens verplicht is, kan diegene deze verplichting, in afwijking van artikel 5:20, tweede lid, van de Algemene wet bestuursrecht, niet inroepen tegenover de in het eerste lid bedoelde ambtenaren. Op deze ambtenaren rust dezelfde geheimhoudingsplicht als op de verrichter dan wel op het College.
