The policyholder who, pursuant to an insurance contract concluded prior to the entry into force of an amendment to the legislation regarding insurance tax, pays premiums, is entitled to recover from the person to whom the premiums are paid that which, due to insurance tax on those premiums, has been claimed in a lesser amount than could have been claimed prior to that entry into force. Stipulations to the contrary are void.
De verzekeringnemer die ingevolge een vóór de inwerkingtreding van een wijziging in de wetgeving inzake assurantiebelasting gesloten verzekering premies voldoet, is bevoegd van hem aan wie de premies worden voldaan, terug te vorderen hetgeen wegens assurantiebelasting over die premies minder is gevorderd dan vóór die inwerkingtreding had kunnen geschieden. Hiermede strijdige bedingen zijn nietig.
