Any person who, pursuant to an insurance contract concluded prior to the entry into force of this Act or an amendment thereof, collects or causes to be collected premiums, is authorised to recover from the policyholder any amount claimed from him by way of insurance tax on those premiums that exceeds what could have been claimed prior to that entry into force. Any stipulations to the contrary are void.
Hij die ingevolge een vóór de inwerkingtreding van deze wet of van een wijziging daarvan gesloten verzekering premies int of doet innen, is bevoegd hetgeen van hem wegens assurantiebelasting over die premies meer is gevorderd dan vóór die inwerkingtreding had kunnen geschieden, terug te vorderen van de verzekeringnemer. Hiermede strijdige bedingen zijn nietig.
