Our Minister may reject an application for the grant of a residence permit for asylum as referred to in Article 29, 29a or 29b, in accordance with Article 39, paragraph 3, of the Procedures Regulation, as unfounded, if the applicant does not qualify under the Qualification Regulation for:

a.

the refugee status, as referred to in Article 13 of the Qualification Regulation;

b.

the subsidiary protection status, as referred to in Article 18 of the Qualification Regulation; or

c.

residence as a family member, as referred to in Article 23, paragraph 1, of the Qualification Regulation.

2.

Our Minister may reject an application for the granting of an asylum residence permit as referred to in Article 29c or 29d, if the conditions set forth therein are not met.

3.

Our Minister may reject an application for the grant of a residence permit for asylum as referred to in Article 28 as unfounded, if it has already been established that the foreign national does not qualify for international protection on the basis of the Qualification Regulation, in accordance with:

a.

Article 40, paragraph 4, of the Procedural Regulation in the phase in which the application is explicitly withdrawn; or

b.

Article 41, paragraphs 1 and 5, of the Procedural Regulation at the moment at which the application is implicitly withdrawn.

4.

An application by a family member as referred to in Article 29c, paragraph 1, for the grant of an asylum residence permit as referred to in Articles 29c or 29d, may be rejected if family reunification is possible in a third country with which the foreign national who has refugee status or subsidiary protection status, or the relevant family member, has special ties.

5.

Rules regarding the application of this Article may be established by or pursuant to an Order in Council (algemene maatregel van bestuur).

Onze Minister kan een aanvraag tot het verlenen van een verblijfsvergunning asiel als bedoeld in artikel 29, 29a of 29b, overeenkomstig artikel 39, derde lid, van de Procedureverordening afwijzen als ongegrond, indien de aanvrager op grond van de Kwalificatieverordening niet in aanmerking komt voor:

a.

de vluchtelingenstatus, bedoeld in artikel 13 van de Kwalificatieverordening;

b.

de subsidiairebeschermingsstatus, bedoeld in artikel 18 van de Kwalificatieverordening; of

c.

verblijf als gezinslid, als bedoeld in artikel 23, eerste lid, van de Kwalificatieverordening.

2.

Onze Minister kan een aanvraag tot het verlenen van een verblijfsvergunning asiel als bedoeld in artikel 29c of 29d afwijzen, indien niet wordt voldaan aan de daarin gestelde voorwaarden.

3.

Onze Minister kan een aanvraag tot het verlenen van een verblijfsvergunning asiel als bedoeld in artikel 28 afwijzen als ongegrond, indien reeds is vastgesteld dat de vreemdeling niet in aanmerking komt voor internationale bescherming op grond van de Kwalificatieverordening, overeenkomstig:

a.

artikel 40, vierde lid, van de Procedureverordening in de fase waarin de aanvraag expliciet wordt ingetrokken; of

b.

artikel 41, eerste en vijfde lid, van de Procedureverordening op het ogenblik waarop de aanvraag impliciet wordt ingetrokken.

Een aanvraag van een gezinslid als bedoeld in artikel 29c, eerste lid, tot het verlenen van een verblijfsvergunning asiel als bedoeld in de artikelen 29c of 29d, kan worden afgewezen, indien gezinshereniging mogelijk is in een derde land waarmee de vreemdeling die de vluchtelingenstatus of de subsidiairebeschermingsstatus heeft of het desbetreffende gezinslid bijzondere banden heeft.

5.

Bij of krachtens algemene maatregel van bestuur kunnen regels worden gesteld over de toepassing van dit artikel.

By decisions of 6 May 2022, the State Secretary for Justice and Security revoked the fixed-term asylum residence permits granted to the parties concerned. The parties concerned constitute a family consisting of two parents and their two adult daughters. They hold Iranian nationality. On 7 August 2017, the Minister granted the mother and the two daughters a fixed-term asylum residence permit pursuant to Article 29, paragraph 1, opening words and under (a), of the Aliens Act 2000 (Vw 2000), as he deemed it credible that they had converted. The father subsequently joined his family, and on 29 March 2018, the Minister granted him a fixed-term asylum residence permit pursuant to Article 29, paragraph 2, opening words and under (a), of the Vw 2000. In the decisions of 6 May 2022, the Minister took the position that the parties concerned had provided false statements with the assistance of the legal advisor. This ruling concerns the question of whether the Minister was entitled to revoke the permits and how a reassessment should take place in a case such as this.
