1. In order to determine whether a party is domiciled in the Member State whose courts are seised of a matter, the court shall apply its internal law.
2. If a party is not domiciled in the Member State whose courts are seised of the matter, then, in order to determine whether the party is domiciled in another Member State, the court shall apply the law of that Member State.
1. Om vast te stellen of een partij woonplaats heeft op het grondgebied van de lidstaat bij een van welks gerechten een zaak aanhangig is, past het gerecht zijn intern recht toe.
2. Indien een partij geen woonplaats heeft in de lidstaat bij een van welks gerechten een zaak aanhangig is, past het gerecht voor de vaststelling of zij een woonplaats heeft in een andere lidstaat, het recht van die lidstaat toe.
