An application may be declared inadmissible pursuant to Article 30a Vw in the cases referred to in Article 38, paragraph 1, of the Procedures Regulation. These cases are further elaborated below. This concerns a further elaboration of paragraph C1/3.2.3 Vc 'Admissibility procedure'.

2.1 First country of asylum (Article 38, paragraph 1, opening words and under (a), in conjunction with Article 58 of the Procedures Regulation)

Article 58 of the Procedural Regulation elaborates on the concept of ‘first country of asylum’. A country that is not part of the European Union, the European Economic Area, or Switzerland shall be considered a first country of asylum for the foreign national if the foreign national has enjoyed (effective) protection there and can still invoke that protection.

In determining whether a third country must be considered a first country of asylum for an individual foreign national, the statements of the foreign national are also of importance. On the basis of that account and information regarding the situation in the ‘first country of asylum’, it shall be assessed whether the conditions of Article 58, paragraph 1, of the Procedural Regulation have been met. If the foreign national makes it plausible that there are elements justifying that the third country cannot be considered a first country of asylum in his case within the meaning of Article 58 of the Procedural Regulation, the IND shall not hold against the foreign national that protection has already been granted to him in the third country concerned. In that case, the IND shall assess whether the foreign national is eligible for international protection in accordance with Chapter C3 of the Vc. The elements that the foreign national may provide in the context of an individual assessment must be related to the conditions mentioned in the first paragraph of Article 58 of the Procedural Regulation.

The concept of ‘first country of asylum’ shall not be applied to applicants who file a petition as a family member of a third-country national or of a citizen of the Union and who, in the Member State processing the petition, are entitled to the rights laid down in the Family Reunification Directive (2003/86/EC) or Directive 2004/38/EC.

(Re)admission to the territory

Article 58, paragraph 1, of the Procedural Regulation describes when a third country can be considered as a first country of asylum. The possibility of (re)admission is not mentioned as a condition therein.

If, however, it is clear in advance that the foreign national will not be admitted to that country, the application cannot be declared inadmissible. Since the foreign national has previously enjoyed protection in the third country, this will not be readily assumed. It is for the foreign national to demonstrate that they will not be readmitted. The foreign national is expected to make a genuine effort to obtain this access.

Unaccompanied minor

A third country may only be considered a first country of asylum for an unaccompanied minor if the conditions of Article 58, paragraph 3, of the Procedure Regulation are met.

In determining whether a third country should be considered a safe third country of asylum for an unaccompanied minor, the IND assesses whether this is contrary to his or her best interests. In doing so, the IND takes into account the factors referred to in Article 26 of Regulation (EU) 2024/1346. Account is taken therein of the availability of sustainable appropriate care and reception.

Insofar as family members or relatives reside in the first country of asylum, the actual reunification of the unaccompanied minor foreign national with his family members or relatives shall only take place if this is in the best interests of the minor foreign national. The starting point in this regard is that it is presumed to be in the best interests of the minor foreign national to be reunited with his family members or relatives.

The IND understands the condition of having received prior assurance from the third country concerned as follows. The IND assumes that the unaccompanied minor will be taken over by the intended first country of asylum if the authorities of the first country of asylum confirm, within a reasonable period determined by the IND, that they will take over the unaccompanied minor.

The IND assumes that the unaccompanied minor foreign national will immediately enjoy effective protection if the authorities of the first country of asylum confirm this.

2.2 Safe third country (Article 38, paragraph 1, opening words and point (b), in conjunction with Articles 59 and 60 of the Procedures Regulation)

Article 59 of the Procedural Regulation states what is understood by the concept of a ‘safe third country’ and when this concept may be applied.

In determining whether a safe third country must be considered safe for the individual foreign national, the account of the foreign national shall constitute the starting point. The IND assesses whether the third country can be regarded as a safe third country in the individual case of the foreign national on the basis of the conditions of Article 59, paragraph 1, of the Procedures Regulation:

a).

the life and liberty of third-country nationals are not threatened on account of race, religion, nationality, membership of a particular social group or political opinion;

b).

third-country nationals do not run a real risk of suffering serious harm as defined in Article 15 of the Qualification Regulation;

c).

third-country nationals shall be protected against refoulement in accordance with the Geneva Convention and against removal in violation of the right to protection against torture and other cruel, inhuman or degrading treatment or punishment, as laid down in international law;

d).

the possibility exists to apply for effective protection and, if the conditions are fulfilled, to obtain it.

If the foreign national makes it plausible that there are elements justifying that the third country cannot be considered a safe third country in his case within the meaning of Article 59 of the Procedural Regulation, the IND shall not apply the concept of a safe third country. In that case, the IND shall assess, in accordance with Chapter C3 of the Aliens Circular (Vc), whether the foreign national qualifies for international protection.

The IND shall in any event assume that a third country cannot be designated as safe if a moratorium on decisions (besluitmoratorium) as referred to in Article 43 of the Aliens Act (Vw) applies to that country. The IND shall also assume that a third country cannot be designated as safe if there is a most exceptional situation of indiscriminate violence, in which the degree of indiscriminate violence is of such a nature that mere presence in the country already creates a real risk of serious harm.

It follows from Article 59, paragraph 5, opening words and under (b), of the Procedural Regulation that the concept of ‘safe third country’ may be applied in three situations:

•.

if a connection exists between the foreign national and the third country;

•.

if it concerns a country of transit; or

•.

if there is an agreement or arrangement with the third country concerned on the basis of which petitions for effective protection must be examined by that third country.

Connection between the foreign national and the third country concerned

The IND shall investigate whether the foreign national has such a connection with the third country that it may reasonably be expected of the foreign national to go to that country.

The IND shall in any event assume that the foreign national has a connection with a third country in the following cases:

•.

the spouse or partner of the foreign national has the nationality of that country;

•.

family members of the petitioner are located in that third country;

•.

the foreign national has previously resided in that country; or

•.

the foreign national has linguistic, cultural or similar ties with that third country.

Transit country

Transit through a third country may include the following situations:

•.

the foreign national has travelled through the territory of a third country;

•.

the foreign national has been at the border or in a transit zone of a third country, whereby the foreign national has had the opportunity to petition the authorities of the third country concerned for effective protection.

If a foreign national has travelled through the territory of a third country before entering the European Union, the concept of a safe third country may be applied, as in that case it can reasonably be assumed that a person requesting international protection could have requested effective protection in a safe third country of transit.

Agreement or arrangement

Both the Union and Member States may conclude agreements or arrangements with third countries, on the basis of which the third country has committed itself to petitions to investigate whether the foreign national is entitled to effective protection. This possibility does not apply to unaccompanied minors.

(Re)admission to the territory

Article 59, first, fourth and fifth paragraph, of the Procedural Regulation describes when a third country can be considered a safe third country.

If it is clear in advance that the foreign national will not be admitted to that country, the application cannot be declared inadmissible. It is for the foreign national to demonstrate that, despite efforts made by him to obtain admission, he will not be (re-)admitted. The foreign national is expected to make an actual effort to obtain this admission.

Unaccompanied minor

A third country may only be considered a safe third country for an unaccompanied minor if the conditions of Article 59, paragraph 6, of the Procedures Regulation are met. A country may not be designated as a safe third country solely because an agreement or arrangement has been concluded with the third country.

In determining whether a third country should be considered as the first country of asylum for an unaccompanied minor, the IND assesses whether this is contrary to his or her best interests. In this regard, account shall be taken of the availability of sustainable appropriate care and reception.

Insofar as family members or relatives are residing in the first country of asylum, the actual reunification of the unaccompanied minor alien with his family members or relatives shall only take place if this is in the best interests of the minor alien. The starting point in this regard is that it is in the best interests of the minor alien to be reunited with his family members or relatives.

The IND assumes that the unaccompanied minor will be taken over by the intended safe third country if the authorities of the safe third country confirm within a reasonable period that they will take over the unaccompanied minor.

The IND assumes that the unaccompanied minor foreign national will immediately enjoy effective protection if the authorities of the safe third country confirm this.

2.3 Protection in another EU Member State (Article 38, paragraph 1, opening words and under (c), Procedural Regulation)

The fact that another Member State has already granted international protection constitutes, pursuant to Article 38, paragraph 1, opening words and under (c), of the Procedural Regulation, as a rule, a ground to reject an application from the same foreign national as inadmissible.

Protection of the foreign national in another Member State may, in any event, be evidenced by:

•.

A residence document;

•.

Eurodac

•.

Information from the relevant Member State demonstrating that the foreign national enjoys protection, or is (again) eligible for protection; or

•.

Statements of the foreign national from which it follows that he enjoys protection in another EU Member State.

The fact that the residence document of the foreign national has expired does not mean that the foreign national no longer enjoys protection in the relevant EU Member State.

The Eurodac system shall be consulted at least two months before a decision is taken on an application for asylum. If it follows therefrom that international protection has been granted, this may be assumed.

Where it does not appear from that system that the status has been withdrawn, it is for the foreign national to demonstrate that he nevertheless no longer enjoys international protection in the other Member State.

2.4 An international criminal court has ensured the safe relocation of the foreign national or is unequivocally taking measures to that effect (Article 38, paragraph 1, opening words and under (d), Procedures Regulation)

Pursuant to Article 38, paragraph 1, introductory words and under (d), of the Procedural Regulation, an application may be declared inadmissible if an international criminal court has provided for the safe relocation of the foreign national to a Member State or a third country or is unequivocally taking measures to that effect, unless new relevant circumstances have arisen which the criminal court or tribunal has not taken into account or there was no legal possibility to invoke circumstances relevant to internationally recognised human rights standards before that international criminal court.

2.5 Application for an asylum residence permit after receipt of a return decision (Article 38, paragraph 1, opening words and point (e), Procedures Regulation)

Pursuant to Article 38, paragraph 1, opening words and under (e), of the Procedural Regulation, an application may be rejected as inadmissible if the foreign national applies for asylum only seven days or later after receipt of a return decision. This concerns, in any event, the situation where the foreign national:

•.

in the context of the imposition of a return decision, it was pointed out that if he believes he has reason to fear something upon return, he must make a wish for asylum known within a period of seven working days from the date of receipt of the return decision, and he has not made use of this;

•.

he has been informed of the consequences of failing to submit an application within that period; and

•.

no new relevant elements have emerged since the expiry of the period of seven working days.

2.6 Subsequent petitions (Article 38, paragraph 2, Procedural Regulation)

An application is declared inadmissible pursuant to Article 30a Vw in the cases as referred to in Article 38, paragraph 2, of the Procedures Regulation. It must concern a subsequent application in which no new relevant elements, within the meaning of Article 55, paragraphs 3 and 5, of the Procedures Regulation, have been brought forward which significantly increase the likelihood of asylum.

The manner in which the IND investigates whether the application can be declared inadmissible is set forth in paragraph C2/5 Vc.

Een aanvraag kan niet-ontvankelijk worden verklaard op grond van artikel 30a Vw in de gevallen als bedoeld in artikel 38, eerste lid, Procedureverordening. Deze gevallen worden hieronder verder uitgewerkt. Dit betreft een nadere uitwerking van paragraaf C1/3.2.3 Vc ‘Ontvankelijkheidsprocedure’.

2.1 Eerste land van asiel (artikel 38, eerste lid aanhef en onder a, jo 58 Procedureverordening)

In artikel 58 Procedureverordening staat het begrip ‘eerste land van asiel’ uitgewerkt. Een land dat geen onderdeel is van de Europese Unie, Europese Economische Ruimte of Zwitserland wordt beschouwd als een eerste land van asiel voor de vreemdeling, indien de vreemdeling daar (doeltreffende) bescherming heeft genoten en nog steeds op die bescherming een beroep kan doen.

Bij de vraag of voor de individuele vreemdeling een derde land als eerste land van asiel moet worden beschouwd, zijn ook de verklaringen van de vreemdeling van belang. Aan de hand van dat relaas en informatie over de situatie in het ‘eerste land van asiel’ wordt beoordeeld of aan de voorwaarden van artikel 58, eerste lid, Procedureverordening is voldaan. Als de vreemdeling aannemelijk maakt dat er sprake is van elementen die rechtvaardigen dat het derde land in zijn geval niet als eerste land van asiel kan worden beschouwd in de zin van artikel 58 Procedureverordening, zal de IND de vreemdeling niet tegenwerpen dat hem in het betreffende derde land reeds bescherming is verleend. In dat geval beoordeelt de IND overeenkomstig hoofdstuk C3 Vc of de vreemdeling in aanmerking komt voor internationale bescherming. De elementen die de vreemdeling in het kader van een individuele beoordeling kan verstrekken, dienen in verband te staan met de in het eerste lid van artikel 58 Procedureverordening genoemde voorwaarden.

Het begrip ‘eerste land van asiel’ mag niet worden toegepast op verzoekers die als gezinslid van een onderdaan van een derde land of van een burger van de Unie een verzoek indienen en die in de lidstaat die het verzoek behandelt, aanspraak kunnen maken op de rechten die zijn vastgelegd in de Gezinsherenigingsrichtlijn (2003/86/EG) of Richtlijn 2004/38/EG.

(Opnieuw) toelaten tot grondgebied

Artikel 58, eerste lid, Procedureverordening beschrijft wanneer een derde land als eerste land van asiel kan worden beschouwd. De mogelijkheid van (weder)toelating wordt daarbij niet als voorwaarde genoemd.

Als echter op voorhand duidelijk is dat de vreemdeling niet tot dat land zal worden toegelaten, kan de aanvraag niet niet-ontvankelijk worden verklaard. Aangezien de vreemdeling eerder in het derde land bescherming heeft genoten, zal dat niet snel worden aangenomen. Het is aan de vreemdeling om aan te tonen dat niet opnieuw zal worden toegelaten. Van de vreemdeling wordt verwacht dat hij zich daadwerkelijk inspant om deze toegang te krijgen.

Niet-begeleide minderjarige

Een derde land kan voor een niet-begeleide minderjarige slechts als een eerste land van asiel worden beschouwd als aan de voorwaarden is voldaan van artikel 58, derde lid, Procedureverordening.

Bij de vaststelling of een derde land voor een niet-begeleide minderjarige beschouwd moet worden als veilig derde land van asiel, beoordeelt de IND of dit in strijd is met zijn of haar belang. Daarbij houdt de IND rekening met de in artikel 26 Verordening (EU) 2024/1346 genoemde factoren. Daarbij wordt rekening gehouden met de beschikbaarheid van duurzame passende zorg en opvang.

Voor zover in het eerste land van asiel gezins- of familieleden woonachtig zijn, zal het daadwerkelijk samenbrengen van de niet-begeleide minderjarige vreemdeling met zijn gezins- of familieleden alleen plaatsvinden indien dit in het belang van de minderjarige vreemdeling is. Uitgangspunt hierbij is dat als uitgangspunt geldt dat het in het belang van de minderjarige vreemdeling is om herenigd te worden met zijn gezins- of familieleden.

De IND verstaat onder de voorwaarde vooraf de verzekering hebben ontvangen van het betrokken derde land, het volgende. De IND neemt aan dat de niet-begeleide minderjarige zal worden overgenomen door het bedoelde eerste land van asiel indien de autoriteiten van het eerste land van asiel binnen een door de IND vastgestelde redelijke termijn bevestigen dat zij de niet-begeleide minderjarige overnemen.

De IND neemt aan dat de niet-begeleide minderjarige vreemdeling onmiddellijk zal genieten van doeltreffende bescherming indien de autoriteiten van het eerste land van asiel dit bevestigen.

2.2 Veilig derde land (artikel 38, eerste lid aanhef en onder b, jo 59 en 60 Procedureverordening)

In artikel 59 Procedureverordening staat wat wordt verstaan onder het begrip ‘veilig derde land’ en wanneer dit begrip mag worden toegepast.

Bij de vraag of een veilig derde land voor de individuele vreemdeling als veilig moet worden beschouwd, vormt het relaas van de vreemdeling het uitgangspunt. De IND beoordeelt of het derde land in het individuele geval van de vreemdeling als veilig derde land kan gelden op grond van de voorwaarden van artikel 59, eerste lid, Procedureverordening:

a).

het leven en de vrijheid van onderdanen van derde landen niet worden bedreigd om redenen van ras, religie, nationaliteit, lidmaatschap van een bepaalde sociale groep of politieke overtuiging;

b).

onderdanen van derde landen geen reëel risico lopen op ernstige schade als gedefinieerd in artikel 15 Kwalificatieverordening;

c).

onderdanen van derde landen worden beschermd tegen refoulement overeenkomstig het Verdrag van Genève en tegen verwijdering in strijd met het recht op vrijwaring tegen foltering en andere wrede, onmenselijke of vernederende behandeling of straffen, zoals neergelegd in het internationaal recht;

d).

de mogelijkheid bestaat om doeltreffende bescherming aan te vragen en, indien de voorwaarden vervuld zijn, te krijgen.

Als de vreemdeling aannemelijk maakt dat er sprake is van elementen die rechtvaardigen dat het derde land in zijn geval niet als veilig derde land kan worden beschouwd in de zin van artikel 59 Procedureverordening, zal de IND het begrip veilig derde land niet toepassen. In dat geval beoordeelt de IND overeenkomstig hoofdstuk C3 Vc of de vreemdeling in aanmerking komt voor internationale bescherming.

De IND neemt in ieder geval aan dat een derde land niet als veilig kan worden aangemerkt wanneer voor dat land een besluitmoratorium als bedoeld in artikel 43 Vw van toepassing is. De IND neemt ook aan dat een derde land niet als veilig kan worden aangemerkt als er aldaar sprake is van de meest uitzonderlijke situatie van willekeurig geweld, waarin de mate van willekeurig geweld van dien aard is dat de enkele aanwezigheid in het land al zorgt voor een reëel risico op ernstige schade.

Uit artikel 59, vijfde lid, aanhef en onder b, Procedureverordening volgt dat het begrip ‘veilig derde land’ in drie situaties mag worden toegepast:

•.

als er een band bestaat tussen de vreemdeling en het derde land;

•.

als sprake is van een land van doorreis; of

•.

als sprake is van een overeenkomst of regeling met het betreffende derde land op grond waarvan verzoeken om doeltreffende bescherming door dat derde land moeten worden onderzocht.

Band tussen de vreemdeling en het betrokken derde land

De IND onderzoekt of de vreemdeling een zodanige band heeft met het derde land dat het van de vreemdeling redelijkerwijs verwacht mag worden dat hij naar dat land gaat.

De IND neemt in de volgende gevallen in ieder geval aan dat de vreemdeling een band heeft met een derde land:

•.

de echtgenoot of partner van de vreemdeling heeft de nationaliteit van dat land;

•.

gezinsleden van de verzoeker bevinden zich in dat derde land;

•.

de vreemdeling heeft eerder in dat land verbleven; of

•.

de vreemdeling taal-, culturele of soortgelijke banden heeft met dat derde land.

Doorreisland

Doorreis door een derde land kan de volgende situaties omvatten:

•.

de vreemdeling heeft door het grondgebied van een derde land gereisd;

•.

de vreemdeling heeft zich aan de grens of in een transitzone van een derde land bevonden, waarbij de vreemdeling de mogelijkheid heeft gehad om bij de autoriteiten van het betrokken derde land om doeltreffende bescherming te verzoeken.

Als een vreemdeling door het grondgebied van een derde land is gereisd, voordat hij de Europese Unie is binnengekomen, kan het concept veilig derde land worden toegepast, aangezien in dat geval redelijkerwijs kan worden verondersteld dat een persoon die om internationale bescherming verzoekt, om doeltreffende bescherming had kunnen verzoeken in een veilig derde land van doorreis.

Overeenkomst of regeling

Zowel de Unie als lidstaten kunnen overeenkomsten of regelingen sluiten met derde landen, op grond waarvan het derde land zich heeft verplicht verzoeken om te onderzoeken of de vreemdeling aanspraak maakt op doeltreffende bescherming. Deze mogelijkheid geldt niet voor niet-begeleide minderjarigen.

(Opnieuw) toelaten tot grondgebied

Artikel 59, eerste, vierde en vijfde lid, Procedureverordening beschrijft wanneer een derde land als veilig derde land kan worden beschouwd.

Als op voorhand duidelijk is dat de vreemdeling niet tot dat land zal worden toegelaten, kan de aanvraag niet niet-ontvankelijk worden verklaard. Het is aan de vreemdeling om aan te tonen dat hij in weerwil van door hem verrichte inspanningen om toelating te verkrijgen niet (opnieuw) zal worden toegelaten. Van de vreemdeling wordt verwacht dat hij zich daadwerkelijk inspant om deze toegang te krijgen.

Niet-begeleide minderjarige

Een derde land kan voor een niet-begeleide minderjarige slechts als een veilig derde land worden beschouwd als aan de voorwaarden is voldaan van artikel 59, zesde lid, Procedureverordening. Een land kan niet als veilig derde land worden aangemerkt enkel omdat er een overeenkomst of regeling met het derde land is gesloten.

Bij de vaststelling of een derde land voor een niet-begeleide minderjarige beschouwd moet worden als eerste land van asiel, beoordeelt de IND of dit in strijd is met zijn of haar belang. Daarbij wordt rekening gehouden met de beschikbaarheid van duurzame passende zorg en opvang.

Voor zover in het eerste land van asiel gezins- of familieleden woonachtig zijn, zal het daadwerkelijk samenbrengen van de niet-begeleide minderjarige vreemdeling met zijn gezins- of familieleden alleen plaatsvinden indien dit in het belang van de minderjarige vreemdeling is. Uitgangspunt hierbij is dat het in het belang van de minderjarige vreemdeling is om herenigd te worden met zijn gezins- of familieleden.

De IND neemt aan dat de niet-begeleide minderjarige zal worden overgenomen door het bedoelde veilig derde land indien de autoriteiten van het veilig derde land binnen een redelijke termijn bevestigen dat zij de niet-begeleide minderjarige overnemen.

De IND neemt aan dat de niet-begeleide minderjarige vreemdeling onmiddellijk zal genieten van doeltreffende bescherming indien de autoriteiten van het veilig derde land dit bevestigen.

2.3 Bescherming in een andere EU-lidstaat (artikel 38, eerste lid, aanhef en onder c, Procedureverordening)

Het feit dat een andere lidstaat reeds internationale bescherming heeft verleend, vormt op grond van artikel 38, eerste lid, aanhef en onder c, Procedureverordening in de regel een reden om een aanvraag van dezelfde vreemdeling als niet-ontvankelijk af te wijzen.

De bescherming van de vreemdeling in een andere lidstaat kan in ieder geval blijken uit:

•.

Een verblijfsdocument;

•.

Eurodac;

•.

Informatie van de betreffende lidstaat waaruit volgt dat de vreemdeling bescherming geniet, dan wel (opnieuw) in aanmerking komt voor bescherming; of

•.

Verklaringen van de vreemdeling waaruit volgt dat hij in een andere EU-lidstaat bescherming geniet.

Wanneer het verblijfsdocument van de vreemdeling verlopen is, wil dat niet zeggen dat de vreemdeling geen bescherming meer geniet in de betreffende EU-lidstaat.

Het Eurodac-systeem wordt geraadpleegd tenminste twee maanden voordat een beslissing wordt genomen op een asielaanvraag. Als daaruit volgt dat internationale bescherming is verleend, dan mag daarvan worden uitgegaan.

Wanneer uit dat systeem niet blijkt dat de status is ingetrokken, dan is het aan de vreemdeling om aannemelijk te maken dat hij in de andere lidstaat toch geen internationale bescherming meer heeft.

2.4 Een internationaal strafgerecht heeft gezorgd voor veilige herplaatsing van de vreemdeling of neemt ondubbelzinnig maatregelen in die zin (artikel 38, eerste lid, aanhef en onder d, Procedureverordening)

Op grond van artikel 38, eerste lid, aanhef en onder d, Procedureverordening kan een aanvraag niet-ontvankelijk worden verklaard als een internationaal strafgerecht heeft gezorgd voor veilige herplaatsing van de vreemdeling naar een lidstaat of een derde land of ondubbelzinnig maatregelen neemt in die zin, tenzij nieuwe relevante omstandigheden zijn ontstaan waarmee het strafhof of tribunaal geen rekening heeft gehouden of er geen juridische mogelijkheid bestond om omstandigheden die relevant zijn voor internationaal erkende mensenrechtennormen aan te voeren voor dat internationale strafgerecht.

2.5 Aanvraag voor een verblijfsvergunning asiel na ontvangst van een terugkeerbesluit (artikel 38, eerste lid, aanhef en onder e, Procedureverordening)

Op grond van artikel 38, eerste lid, aanhef en onder e, Procedureverordening kan een aanvraag worden afgewezen als niet-ontvankelijk als de vreemdeling asiel aanvraagt pas zeven dagen of later na ontvangst van een terugkeerbesluit. Het gaat in ieder geval om de situatie dat de vreemdeling:

in het kader van het opleggen van een terugkeerbesluit erop is gewezen dat indien hij meent bij terugkeer iets te vrezen te hebben een asielwens kenbaar dient te maken binnen een periode van zeven werkdagen vanaf de datum van ontvangst van het terugkeerbesluit en hij hiervan geen gebruik heeft gemaakt;

•.

hij op de hoogte is gebracht van de gevolgen van het niet doen van een aanvraag binnen die termijn; en

•.

er sinds het verstrijken van de termijn van zeven werkdagen geen nieuwe relevante elementen naar voren zijn gekomen.

2.6 Volgende aanvragen (artikel 38, tweede lid, Procedureverordening)

Een aanvraag wordt niet-ontvankelijk verklaard op grond van artikel 30a Vw in de gevallen zoals bedoeld in artikel 38, tweede lid, Procedureverordening. Het moet gaan om een volgende aanvraag waarbij geen nieuwe relevante elementen, in de zin van artikel 55, derde en vijfde lid, Procedureverordening naar voren zijn gebracht die de kans op asiel aanzienlijk groter maken.

De wijze waarop de IND onderzoekt of de aanvraag niet-ontvankelijk kan worden verklaard is neergelegd in paragraaf C2/5 Vc.
