5.1 Medical examination, hearing and deciding

When the IND has doubts concerning the condition or the fitness of the foreign national to have an interview, the IND offers the foreign national a medical examination regarding the interview and decision pursuant to Article 13, paragraph 11 of the Procedures Regulation. The medical examination and the subsequent advice form part of the assessment of whether the foreign national is in need of special procedural safeguards, as laid down in Article 20, paragraph 4 of the Procedures Regulation. The IND determines, partly on the basis of the medical advice, in what manner appropriate support is provided and in what manner account is taken of the conclusions from the medical advice (Article 13, paragraph 11 of the Procedures Regulation).

The IND determines in the triage as laid down in paragraph C1/3 Vc whether the foreign national is offered a medical advice. From the screening form, the preliminary vulnerability check or from other relevant signals and information, doubt may arise regarding the condition or the fitness of the foreign national to be heard. Such doubt may also arise during the procedure. In that case, a medical examination on hearing and deciding may be offered in order to determine whether an interview can be conducted and, if so, whether there are circumstances that must be taken into account during the interview.

Participation in the medical examination is voluntary. The foreign national shall grant written consent for participation in the medical examination.

The processing of the application of the foreign national shall commence without medical advice if the foreign national has not granted written consent for the medical examination. The IND shall not reject the application on the grounds of the refusal of the foreign national to participate in the medical examination.

The medical advice may give cause to decide to apply the parallel procedure (see paragraph A3/7.3 Vc).

5.2 Forensic medical examination

If the IND considers it relevant for the assessment of the application for the granting of an asylum residence permit, the foreign national shall be offered a forensic medical examination into indications of past persecution or serious harm. If the IND does not consider the examination relevant, the foreign national may arrange a forensic medical examination on their own initiative and at their own expense.

In determining whether a forensic medical examination is relevant, the IND shall take into account the following circumstances:

the statements of the foreign national regarding the presence of significant physical and/or psychological traces;

•.

any medical documents submitted by the foreign national in which mention is made of significant physical and/or psychological traces;

•.

the presence of other evidence in support of the assertion that there is a threat of persecution or serious harm upon return;

•.

the statements of the foreign national regarding the cause of the physical and/or psychological traces in relation to that which public sources report about the country of origin; and

•.

the question of whether the results of a forensic medical examination are of decisive importance for the decision on the application for an asylum residence permit.

Indications of the presence of scars, physical complaints and/or psychological complaints may, inter alia, emerge from:

•.

the ‘medical advice hearing & deciding’;

•.

the reports of the hearings; and

•.

medical documents

The IND cannot independently establish a medical diagnosis. During the interviews, the IND may pose questions regarding the presence of scars, physical complaints and/or psychological complaints of the foreign national. The IND does not request the foreign national to show scars and/or physical complaints. The mere assertion by the foreign national that he suffers from psychological complaints is insufficient as an indication for initiating a forensic medical examination. In principle, psychological complaints must be substantiated with medical documents.

The forensic medical examination may only be performed with the consent of the foreign national. The IND shall not reject the application for an asylum residence permit solely on the grounds of the refusal of the foreign national to participate in the forensic medical examination.

The forensic medical examination is primarily aimed at truth-finding. This means that the forensic medical examination can be deployed as an instrument to contribute to the assessment of credibility in an application for an asylum residence permit.

Forensic medical examination may consist of three components:

physical examination (external and/or internal);

•.

psychological examination; and

•.

psychodiagnostic examination

The central question posed when a forensic medical examination is initiated is: to what extent is there causality between physical and/or psychological traces on the one hand and the manner of their origin on the other. In this regard, consideration may be given to physical traces resulting from torture, rape, and other serious forms of violence, or serious psychological damage in relation to the asylum account. Where possible, the forensic medical examination also consists of an investigation into injury dating. Injury dating is understood to mean the moment at which the injury was sustained. The purpose of the forensic medical examination is not to present or to assess the grounds for asylum. This does not preclude the foreign national from providing the examining physician with information (sensitive in terms of privacy, guilt, or shame) that was not mentioned, or was mentioned differently, during the hearing.

The IND shall include the forensic medical examination in the assessment of credibility and the final decision on the application for an asylum residence permit.

The IND shall not initiate a forensic medical examination within the framework of the assessment of the possibility of revoking an asylum residence permit.

5.3 Determination of age

Recognition of age determination by another Member State

In accordance with Article 25, paragraph 7, of the Procedural Regulation, the IND may recognise a decision taken by another Member State regarding the age assessment, provided that such age assessment was conducted in accordance with Union law.

Age interview

If there are suspicions of evident majority in the case of an unaccompanied minor and the alleged minority is not substantiated by authentic identity documents, the IND shall conduct an age interview.

During the OVA process, suspicions of evident majority are identified. In the event of such suspicions, the age interview shall, in principle, take place as soon as possible after the triage.

If, during the OVA process, no suspicions of evident majority are identified, the claimed minority shall be provisionally assumed.

This leaves unaffected that at a later stage in the proceedings, if there are sufficient grounds thereto, an age interview may still be conducted. This age interview may be conducted separately or during the hearing.

Examples of connecting factors are:

•.

signals from chain partners;

•.

information from other Member States;

•.

information from family members who entered the country at a later date;

•.

(copies of) identity documents that come to light at a later stage.

During this age interview, it is assessed on the basis of physical appearance, behaviour, the statements of the foreign national and any other relevant circumstances whether the unaccompanied foreign national who claims to be a minor is, without any doubt, older than 18 years of age (evidently of age). If, following the age interview, it is not concluded that the person is evidently of age, the IND shall for the time being proceed on the basis of the claimed minority.

Medical age examination

The IND shall, in any event, carry out the medical age assessment in accordance with Article 25 of the Procedures Regulation.

5.1 Medisch onderzoek horen en beslissen

Wanneer de IND twijfelt over de toestand of de geschiktheid van de vreemdeling om een onderhoud te hebben, biedt de IND de vreemdeling op grond van artikel 13, elfde lid Procedureverordening een medisch onderzoek horen en beslissen aan. Het medisch onderzoek en het daarop volgende advies maken deel uit van de beoordeling of de vreemdeling behoefte heeft aan bijzondere procedurele waarborgen, zoals neergelegd in artikel 20, vierde lid Procedureverordening. De IND bepaalt mede op basis van het medisch advies op welke wijze passende steun wordt geboden en op welke wijze rekening gehouden wordt met de conclusies uit het medisch advies (artikel 13, elfde lid Procedureverordening).

De IND bepaalt in de triage zoals neergelegd in paragraaf C1/3 Vc of de vreemdeling een medisch advies wordt aangeboden. Uit het screeningsformulier, de voorlopige kwetsbaarheidscheck of uit andere relevante signalen en informatie kan twijfel volgen over de toestand of de geschiktheid van de vreemdeling om gehoord te worden. Die twijfel kan ook ontstaan gedurende de procedure. In dat geval kan een medisch onderzoek horen en beslissen worden aangeboden teneinde te kunnen bepalen of een gehoor kan worden afgenomen en zo ja, of er omstandigheden zijn waar in het gehoor rekening mee moet worden gehouden.

Deelname aan het medisch onderzoek is vrijwillig. De vreemdeling verleent schriftelijk toestemming voor deelname aan het medisch onderzoek.

De behandeling van de aanvraag van de vreemdeling start zonder medisch advies als de vreemdeling geen schriftelijke toestemming heeft verleend voor het medisch onderzoek. De IND wijst de aanvraag niet af op grond van de weigering van de vreemdeling deel te nemen aan het medisch onderzoek.

Het medisch advies kan aanleiding geven te besluiten de parallelle procedure toe te passen (zie paragraaf A3/7.3 Vc).

5.2 Forensisch medisch onderzoek

Als de IND het voor de beoordeling van de aanvraag tot het verlenen van een verblijfsvergunning asiel relevant vindt, wordt aan de vreemdeling een forensisch medisch onderzoek aangeboden naar aanwijzingen van vroegere vervolging of ernstige schade. Indien de IND het onderzoek niet relevant vindt, kan de vreemdeling op eigen initiatief en kosten een forensisch medisch onderzoek regelen.

Bij het bepalen of een forensisch medisch onderzoek relevant is, betrekt de IND de volgende omstandigheden:

de verklaringen van de vreemdeling omtrent de aanwezigheid van significante fysieke en/of psychische sporen;

•.

eventuele door de vreemdeling overgelegde medische stukken waarin gewag wordt gemaakt van significante fysieke en/of psychische sporen;

•.

de aanwezigheid van ander bewijsmateriaal ter staving van de stelling dat bij terugkeer vervolging of ernstige schade dreigt;

•.

de verklaringen van de vreemdeling over de oorzaak van de fysieke en/of psychische sporen in relatie tot hetgeen openbare bronnen over het land van herkomst melden; en

•.

de vraag of de uitslag van een forensisch medisch onderzoek van doorslaggevend belang is voor de beslissing op de aanvraag voor een verblijfsvergunning asiel.

Indicaties over de aanwezigheid van littekens, fysieke klachten en/of psychische klachten kunnen onder andere naar voren komen uit:

•.

het ‘medisch advies horen & beslissen’;

•.

de rapporten van de gehoren; en

•.

medische stukken.

De IND kan niet zelf een medische diagnose stellen. De IND kan tijdens de gehoren vragen stellen over de aanwezigheid van littekens, fysieke klachten en/of psychische klachten bij de vreemdeling. De IND vraagt niet aan de vreemdeling of hij littekens en/of fysieke klachten wil laten zien. De enkele stelling van de vreemdeling dat hij psychische klachten heeft, is onvoldoende als indicatie voor het opstarten van forensisch medisch onderzoek. In beginsel moeten psychische klachten onderbouwd worden met medische stukken.

Het forensisch medisch onderzoek kan alleen uitgevoerd worden met toestemming van de vreemdeling. De IND wijst de aanvraag voor een verblijfsvergunning asiel niet af enkel op grond van de weigering van de vreemdeling deel te nemen aan het forensisch medisch onderzoek.

Het forensisch medisch onderzoek is primair op waarheidsvinding gericht. Dit betekent dat het forensisch medisch onderzoek als instrument kan worden ingezet om een bijdrage te leveren aan de geloofwaardigheidsbeoordeling bij een aanvraag voor een verblijfsvergunning asiel.

Het forensisch medisch onderzoek kan bestaan uit drie onderdelen:

fysiek onderzoek (uitwendig en/of inwendig);

•.

psychisch onderzoek; en

•.

psychodiagnostisch onderzoek.

De centrale vraag die gesteld wordt wanneer een forensisch medisch onderzoek wordt opgestart, is: In welke mate is er sprake van causaliteit tussen fysieke en/of psychische sporen enerzijds en de wijze van het ontstaan daarvan anderzijds. Hierbij kan gedacht worden aan fysieke sporen als gevolg van marteling, verkrachting en andere ernstige vormen van geweld of ernstige psychische schade in relatie tot het asielrelaas. Waar mogelijk bestaat het forensisch medisch onderzoek ook uit onderzoek naar letseldatering. Onder letseldatering wordt verstaan het moment waarop het letsel is opgelopen. Het doel van het forensisch medisch onderzoek is niet om de asielmotieven naar voren te brengen of te toetsen. Dit sluit niet uit dat de vreemdeling aan de onderzoekende arts (privacy-/schuld-/schaamtegevoelige) informatie verstrekt die tijdens het gehoor niet of anders benoemd is.

De IND weegt het forensisch medisch onderzoek mee in de geloofwaardigheidsbeoordeling en de uiteindelijke beslissing op de aanvraag voor een verblijfsvergunning asiel.

De IND start geen forensisch medisch onderzoek op in het kader van de beoordeling van de mogelijkheid tot intrekking van een verblijfsvergunning asiel.

5.3 Leeftijdsbepaling

Erkenning leeftijdsbepaling andere lidstaat

Overeenkomstig artikel 25, zevende lid, Procedureverordening, kan de IND een beslissing die een andere lidstaat over de leeftijdsbepaling heeft genomen erkennen, zolang die leeftijdsbepaling overeenkomstig het Unierecht is verricht.

Leeftijdsinterview

Indien er bij een niet-begeleide minderjarige vermoedens zijn van evidente meerderjarigheid en de gestelde minderjarigheid niet met authentieke identiteitsdocumenten wordt onderbouwd, houdt de IND een leeftijdsinterview.

Tijdens het OVA-proces worden vermoedens van evidente meerderjarigheid onderkend. Het leeftijdsinterview vindt bij dergelijke vermoedens in beginsel zo spoedig mogelijk na de triage plaats.

Indien tijdens het OVA-proces geen vermoedens van evidente meerderjarigheid worden onderkend, wordt de gestelde minderjarigheid vooralsnog aangenomen.

Dit laat onverlet dat in een later stadium in de procedure, indien hier voldoende aanknopingspunten voor zijn, alsnog een leeftijdsinterview kan worden gehouden. Dit leeftijdsinterview kan afzonderlijk worden gehouden of tijdens het gehoor.

Voorbeelden van aanknopingspunten zijn:

•.

signalen van ketenpartners;

•.

informatie van andere lidstaten;

•.

informatie van later ingereisde gezinsleden;

•.

(kopieën van) identiteitsdocumenten die op een later moment aan het licht komen.

Tijdens dit leeftijdsinterview wordt op basis van uiterlijke kenmerken, het gedrag, de verklaringen van de vreemdeling en eventuele andere relevante omstandigheden beoordeeld of de niet-begeleide vreemdeling die stelt minderjarig te zijn, zonder enige twijfel ouder is dan 18 jaar (evident meerderjarig). Indien na het leeftijdsinterview niet tot evidente meerderjarigheid wordt geconcludeerd, gaat de IND vooralsnog uit van de gestelde minderjarigheid.

Medisch leeftijdsonderzoek

De IND voert het medisch leeftijdsonderzoek in ieder geval uit in overeenstemming met artikel 25 van de Procedureverordening.
