Article 6septies
in forceIf the agent or representative of the proprietor of a trademark in one of the countries of the Union applies for the registration of that trademark in his own name without the consent of such proprietor, the proprietor shall be entitled to oppose the registration applied for, or to demand its cancellation, or, if the law of the country so allows, to demand the assignment of the registration in his favour, unless such agent or representative justifies his actions.
Subject to the provisions of the first paragraph, the trademark proprietor has the right to oppose the use of his trademark by his agent or representative, if he has not consented to such use.
National legislation shall have the authority to provide for a reasonable period within which the trademark proprietor must exercise the rights provided for in this Article.
Indien de agent of de vertegenwoordiger van de houder van een merk in een der landen van de Unie, zonder de toestemming van deze houder de inschrijving van dat merk op eigen naam in één of meer van die landen vraagt, zal de houder het recht hebben om zich te verzetten tegen de gevraagde inschrijving, of om de doorhaling te vorderen, ofwel, indien de wet van het land dit toestaat, om de overdracht van de inschrijving te zijnen behoeve te vorderen, tenzij de agent of vertegenwoordiger zijn handelingen rechtvaardigt.
De merkhouder heeft, onder voorbehoud van het bepaalde in het eerste lid, het recht zich te verzetten tegen het gebruik van zijn merk door zijn agent of vertegenwoordiger, indien hij met dit gebruik niet heeft ingestemd.
De nationale wetgevingen hebben de bevoegdheid te voorzien in een redelijke termijn, waarbinnen de merkhouder zijn in dit artikel voorziene rechten zal moeten uitoefenen.
