1).

The nationals of each of the countries of the Union shall, as regards the protection of industrial property, enjoy in all the other countries of the Union the advantages that their respective laws now grant, or may hereafter grant, to their own nationals, all without prejudice to the rights specifically provided for by this Convention. Consequently, they shall have the same protection as the latter, and the same legal remedy against any infringement of their rights, provided that they comply with the conditions and formalities imposed upon nationals.

However, for the enjoyment of any of the rights of industrial property of those who belong to the Union, it may not be required that they have a domicile or an establishment in the country where protection is claimed.

The provisions of the legislation of each of the countries of the Union regarding judicial or administrative proceedings and jurisdiction, as well as the choice of domicile or the appointment of an authorised agent, should the laws on industrial property so require, are expressly reserved.

De onderdanen van elk van de landen der Unie zullen in alle andere landen der Unie, wat betreft de bescherming van de industriële eigendom, de voordelen genieten, welke de onderscheidene wetten op dit ogenblik aan de nationalen toekennen, dit alles onverminderd de rechten, welke door dit Verdrag in het bijzonder worden toegekend. Dientengevolge zullen zij dezelfde bescherming hebben als dezen en hetzelfde wettelijk verhaal tegen elke inbreuk op hun rechten, mits zij de voorwaarden en formaliteiten nakomen, aan de nationalen opgelegd.

Echter kan voor het genot van geen der rechten van industriële eigendom van hen, die tot de Unie behoren, geëist worden, dat zij een woonplaats of inrichting hebben in het land, waar op de bescherming aanspraak wordt gemaakt.

De bepalingen der wetgeving van elk van de landen der Unie met betrekking tot de rechterlijke of administratieve procesgang en de bevoegdheid, benevens tot de keuze van domicilie of het stellen van een gemachtigde, indien de wetten op de industriële eigendom zulks zouden vorderen, worden uitdrukkelijk voorbehouden.
