If this is necessary for the application of Article 39, paragraph 1 or 3, the person claimed shall be arrested by order of the public prosecutor instructed to that effect by Our Minister for a period not exceeding three days. If the extradition could not take place within the period of three days, the order for arrest may be extended once by the public prosecutor for a period not exceeding three days.
Following the extension of the term referred to in the first paragraph by the public prosecutor, it may be extended by the court exclusively upon the motion of the public prosecutor. Article 38, paragraphs one and two, shall apply mutatis mutandis.
An extension as referred to in the second paragraph may only take place if, due to special circumstances, the surrender could not have been effected within the period of 6 days.
Indien zulks voor de toepassing van artikel 39, eerste of derde lid, noodzakelijk is, wordt de opgeëiste persoon op bevel van de daartoe door Onze Minister aangeschreven officier van justitie aangehouden voor ten hoogste drie dagen. Indien de uitlevering niet binnen de termijn van drie dagen heeft kunnen plaatsvinden, kan het bevel tot aanhouding door de officier van justitie eenmaal voor ten hoogste drie dagen worden verlengd.
Na verlenging van de in het eerste lid bedoelde termijn door de officier van justitie, kan deze uitsluitend op vordering van de officier van justitie door de rechtbank worden verlengd. Artikel 38, eerste en tweede lid, is van overeenkomstige toepassing.
Een verlenging als bedoeld in het tweede lid kan alleen geschieden wanneer de uitlevering door bijzondere omstandigheden niet binnen de termijn van 6 dagen heeft kunnen plaatshebben.
