Conditions for extradition

Extradition shall not be granted except under the general condition that the person claimed shall only be prosecuted, punished, or in any other manner restricted in his personal liberty, with the express consent of Our Minister, in respect of offences committed prior to the time of his extradition for which he has not been extradited.

Our Minister may grant the consent referred to in the preceding paragraph with respect to:

a.

criminal offences for which the requested person, pursuant to the applicable treaty, could have been extradited to the state from which the request for consent originated;

b.

other facts, insofar as these are punishable under both the law of the state from which the request for consent originated and the law of the Netherlands, and the possibility of extradition for these is not excluded pursuant to Articles 8-11 of this Act.

Extradition shall furthermore not be granted except under the general condition that the person claimed shall only be made available to the authorities of a third state with the express consent of Our Minister, in respect of acts committed prior to the time of his extradition. Such consent may be granted in respect of criminal offences for which the person claimed could have been extradited by the Netherlands to the third state.

The decision of Our Minister regarding a petition for consent as referred to in the first and third paragraphs shall be communicated to the State from which that petition originated through diplomatic channels, unless otherwise provided for by treaty.

The third paragraph shall apply mutatis mutandis to petitions from a Member State of the European Union for the onward surrender to a third state of a person who was surrendered by the Netherlands to the issuing judicial authority of that Member State under the condition referred to in Article 14, paragraph 4, of the Surrender Act (Overleveringswet).

With regard to the Member States of the European Union, exceptions for cases other than those referred to in the fifth paragraph may be provided for by treaty.

Uitlevering wordt niet toegestaan dan onder het algemene beding, dat de opgeëiste persoon alleen met uitdrukkelijke toestemming van Onze Minister zal worden vervolgd, gestraft, of op enige andere wijze in zijn persoonlijke vrijheid beperkt, terzake van feiten die vóór het tijdstip van zijn uitlevering zijn begaan en waarvoor hij niet is uitgeleverd.

Onze Minister kan de in het vorige lid bedoelde toestemming geven ten aanzien van:

a.

strafbare feiten waarvoor de opgeëiste persoon, krachtens het toepasselijke verdrag, aan de staat van wie het verzoek om toestemming is uitgegaan had kunnen worden uitgeleverd;

b.

andere feiten, voor zover deze zowel naar het recht van de staat van wie het verzoek om toestemming is uitgegaan als naar dat van Nederland strafbaar zijn en de mogelijkheid van uitlevering daarvoor niet krachtens de artikelen 8-11 van deze wet is uitgesloten.

Uitlevering wordt voorts niet toegestaan dan onder het algemene beding, dat de opgeëiste persoon alleen met uitdrukkelijke toestemming van Onze Minister ter beschikking zal worden gesteld van de autoriteiten van een derde staat, terzake van feiten die vóór het tijdstip van zijn uitlevering zijn begaan. De toestemming kan worden gegeven ten aanzien van strafbare feiten waarvoor de opgeëiste persoon door Nederland aan de derde staat had kunnen worden uitgeleverd.

De beslissing van Onze Minister op een verzoek om toestemming als bedoeld in het eerste en het derde lid wordt ter kennis van de staat van wie dat verzoek is uitgegaan gebracht langs diplomatieke weg, tenzij bij verdrag in een andere weg is voorzien.

Het derde lid is van overeenkomstige toepassing op verzoeken van een lidstaat van de Europese Unie tot verderlevering aan een derde staat van een persoon die door Nederland onder het beding, bedoeld in artikel 14, vierde lid, van de Overleveringswet, werd overgeleverd aan de uitvaardigende justitiële autoriteit van die lidstaat.

6.

Ten aanzien van de lidstaten van de Europese Unie kan bij verdrag worden voorzien in uitzonderingen voor andere dan de in het vijfde lid bedoelde gevallen.
