At the time of entry into force of this article, the officials of the secretariat referred to in Article 10, paragraph 1, whose names and positions are stated on a list established by Our Minister in consultation with the Dutch Data Protection Authority (Autoriteit persoonsgegevens), are by operation of law dismissed and appointed as officials in the service of the Dutch Data Protection Authority. The transfer of the officials referred to in the previous sentence shall take place with a legal status that is, as a whole, at least equivalent to that which applied to each of them on the day prior to the date of entry into force of this article.
Our Minister shall determine, in agreement with Our Minister of Finance, which assets of the State shall be allocated to the Dutch Data Protection Authority (Autoriteit persoonsgegevens).
The assets referred to in the fourth paragraph shall, at the time of the entry into force of this Article, pass by universal title at a value to be determined by Our Minister in agreement with Our Minister of Finance.
In the event that registered property is transferred pursuant to the fourth and fifth paragraphs, Our Minister of Finance shall, without delay, cause the transfer of said registered property to be entered into the public registers referred to in Section 2 of Title 1 of Book 3 of the Civil Code. Article 24, paragraph 1, of Book 3 of the Civil Code shall not apply.
In legal proceedings and lawsuits in which the Dutch Data Protection Authority (Autoriteit persoonsgegevens) is involved, the Dutch Data Protection Authority shall, at the time of the entry into force of this article, succeed the State or Our Minister.
In cases in which, prior to the time of entry into force of this article, a request has been made to the National Ombudsman to conduct an investigation, or the National Ombudsman has initiated an investigation into conduct that can be attributed to the Dutch Data Protection Authority (Autoriteit persoonsgegevens), the Dutch Data Protection Authority shall, at that time, replace Our Minister as the administrative authority within the meaning of the National Ombudsman Act.
Op het tijdstip van inwerkingtreding van dit artikel zijn de ambtenaren van het secretariaat, bedoeld in artikel 10, eerste lid, van wie naam en functie zijn vermeld op een door Onze Minister in overleg met de Autoriteit persoonsgegevens vastgestelde lijst, van rechtswege ontslagen en aangesteld als ambtenaar in dienst van de Autoriteit persoonsgegevens. De overgang van de in de vorige volzin bedoelde ambtenaren vindt plaats met een rechtspositie die als geheel ten minste gelijkwaardig is aan die welke voor elk van hen gold op de dag voor de datum van inwerkingtreding van dit artikel.
Onze Minister bepaalt in overeenstemming met Onze Minister van Financiën welke vermogensbestanddelen van de Staat worden toebedeeld aan de Autoriteit persoonsgegevens.
De in het vierde lid bedoelde vermogensbestanddelen gaan op het tijdstip van inwerkingtreding van dit artikel onder algemene titel over op tegen een door Onze Minister in overeenstemming met Onze Minister van Financiën te bepalen waarde.
Ingeval krachtens het vierde en het vijfde lid registergoederen overgaan, doet Onze Minister van Financiën de overgang van die registergoederen onverwijld inschrijven in de openbare registers, bedoeld in afdeling 2 van titel 1 van Boek 3 van het Burgerlijk Wetboek. Artikel 24, eerste lid, van Boek 3 van het Burgerlijk Wetboek is niet van toepassing.
In wettelijke procedures en rechtsgedingen, waarbij de Autoriteit persoonsgegevens is betrokken, treedt op het tijdstip van inwerkingtreding van dit artikel de Autoriteit persoonsgegevens in de plaats van de Staat dan wel Onze Minister.
In zaken waarin voor het tijdstip van inwerkingtreding van dit artikel aan de Nationale ombudsman is verzocht een onderzoek te doen dan wel de Nationale ombudsman een onderzoek heeft ingesteld naar een gedraging die kan worden toegerekend aan de Autoriteit persoonsgegevens, treedt de Autoriteit persoonsgegevens op dat tijdstip als bestuursorgaan in de zin van de Wet Nationale ombudsman in de plaats van Onze Minister.
