Persons entitled to trees or plantings or the managers of the land on which the trees or plantings are located are obliged, upon a written request from the provider of a public electronic communications network, to shorten the roots thereof within two weeks, insofar as these are or become reasonably obstructive to the maintenance of cables serving the network, as a result of which the operation of the network is endangered.
In the event of a serious obstruction or disruption of communication, a provider of a public electronic communications network may immediately proceed to the shortening of roots, after which it shall notify the entitled party or manager thereof in writing as soon as possible, but no later than the day following the works.
The provider of a public electronic communications network shall compensate the entitled party or manager for damage resulting from the shortening of roots.
Rechthebbenden op bomen of beplantingen of de beheerders van de grond waarop de bomen of beplantingen zich bevinden zijn verplicht op schriftelijk verzoek van de aanbieder van een openbaar elektronisch communicatienetwerk binnen twee weken de wortels daarvan in te korten, voor zover deze redelijkerwijs hinderlijk zijn of worden voor de instandhouding van kabels ten dienste van het netwerk waardoor de exploitatie van het netwerk in gevaar komt.
In geval van ernstige belemmering of storing van de communicatie kan een aanbieder van een openbaar elektronisch communicatienetwerk onmiddellijk tot het inkorten van wortels overgaan, waarna deze zo spoedig mogelijk hiervan schriftelijk aan de rechthebbende of beheerder kennis geeft, doch niet later dan de dag volgend op de werkzaamheden.
De aanbieder van een openbaar elektronisch communicatienetwerk vergoedt aan de rechthebbende of beheerder de schade voortvloeiend uit het inkorten van wortels.
