Any person who provides a public electronic communications network or a public electronic communications service, with the exception of a number-independent interpersonal communications service, or who constructs or provides associated facilities, with the exception of a person who provides an electronic programme guide, shall notify the Authority for Consumers and Markets thereof.
The following data shall be submitted with the notification:
name, address and country of establishment of the provider;
where applicable, the address of the website of the provider that is used for offering a network or service as referred to in the first paragraph;
the number referred to in Article 9, point (a), of the Commercial Register Act 2007 or, if the provider is not registered in accordance with the Commercial Register Act 2007, a comparable registration number from the country in which the provider is established;
name of a contact person and contact details;
a brief description of the networks, services or facilities referred to in the first paragraph;
date on which the activities are presumed to commence.
The Authority for Consumers and Markets shall determine the manner in which the notification is made and shall give notice thereof in the Government Gazette (Staatscourant).
The data referred to in the second paragraph shall be collected solely for the purpose of the proper implementation of this Act and shall be limited to what is strictly necessary for establishing the identity and the capacity of the person referred to in the first paragraph.
The Authority for Consumers and Markets shall register the person referred to in the first paragraph upon receipt of the notification referred to in that paragraph and the data pertaining thereto.
The Authority for Consumers and Markets shall provide a copy of the received notifications to BEREC.
Degene die een openbaar elektronisch communicatienetwerk of een openbare elektronische communicatiedienst, met uitzondering van een nummeronafhankelijke interpersoonlijke communicatiedienst, aanbiedt dan wel bijbehorende faciliteiten aanlegt of aanbiedt, met uitzondering van degene die een elektronische programmagids aanbiedt, doet daarvan mededeling aan de Autoriteit Consument en Markt.
Bij de mededeling worden de volgende gegevens overgelegd:
naam, adres en land van vestiging van de aanbieder;
in voorkomend geval het adres van de website van de aanbieder dat wordt gebruikt voor het aanbieden van een netwerk of dienst als bedoeld in het eerste lid;
het nummer, bedoeld in artikel 9, onderdeel a, van de Handelsregisterwet 2007 of, indien de aanbieder niet is ingeschreven overeenkomstig de Handelsregisterwet 2007, een daarmee vergelijkbaar registratienummer van het land waarin de aanbieder is gevestigd;
naam van een contactpersoon en contactgegevens;
een korte beschrijving van de in het eerste lid bedoelde netwerken, diensten of faciliteiten;
datum waarop de activiteiten vermoedelijk van start gaan.
De Autoriteit Consument en Markt stelt vast op welke wijze de mededeling wordt gedaan en doet daarvan mededeling in de Staatscourant.
De gegevens, bedoeld in het tweede lid, worden slechts verzameld ten behoeve van de goede uitvoering van deze wet en zijn beperkt tot hetgeen strikt noodzakelijk is voor het vaststellen van de identiteit en de hoedanigheid van degene, bedoeld in het eerste lid.
De Autoriteit Consument en Markt registreert degene, bedoeld in het eerste lid, na ontvangst van de in dat lid bedoelde mededeling en de daarbij behorende gegevens.
De Autoriteit Consument en Markt verstrekt een afschrift van de ontvangen mededelingen aan BEREC.
