Following the entry into force of the Act on the implementation of the European regulatory framework for the electronic communications sector 2002, the following applies:
with regard to the processing of traffic data, as referred to in Article 11.5, paragraph 2, that the provider shall provide the subscriber with the data, as referred to in Article 11.5, paragraph 4, within six months;
that the consent, as referred to in Article 11.5, paragraph 3, is not required for traffic data that are already in use for the purpose mentioned in Article 11.5, paragraph 3, point (a);
with regard to the traffic data referred to in point (b), that the provider shall notify the subscriber within six months of the information referred to in Article 11.5, paragraph 4. The subscriber shall be deemed to have granted consent with regard to this use, unless he has indicated in writing to the relevant provider within a period of two months after the dispatch of the notification that no consent is granted for the use in question.
Na inwerkingtreding van de Wet implementatie Europees regelgevingskader voor de elektronische communicatiesector 2002, geldt:
ten aanzien van de verwerking van verkeersgegevens, bedoeld in artikel 11.5, tweede lid, dat de aanbieder binnen zes maanden de abonnee de gegevens verstrekt, bedoeld in artikel 11.5, vierde lid;
dat de toestemming, bedoeld in artikel 11.5, derde lid, niet is vereist voor de verkeersgegevens die reeds in gebruik zijn voor het doel dat is genoemd in artikel 11.5, derde lid, onderdeel a;
ten aanzien van de verkeersgegevens, bedoeld in onderdeel b, dat de aanbieder binnen zes maanden aan de abonnee mededeling doet van de informatie, bedoeld in artikel 11.5, vierde lid. De abonnee wordt geacht met betrekking tot dit gebruik toestemming te hebben verleend, tenzij hij binnen een termijn van twee maanden na verzending van de mededeling schriftelijk aan de desbetreffende aanbieder te kennen heeft gegeven dat voor het desbetreffende gebruik geen toestemming wordt gegeven.
